HomeMy WebLinkAboutResolution - 2693 - Agreement - Lubbock County - Emergency Animal Control Services - 12/10/1987DGV: j s orM iirinni Resolution #2693 December 10, 1987 Item #22 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Animal Con- trol Services Agreement by and between the City of Lubbock and Lubbock County for emergency animal control services in Lubbock County outside the City limits, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Vandiver, First Assistant City Attorney Resolution #2693 ANIMAL CONTROL SERVICES AGREEMENT THE STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK § THIS Interlocal Agreement entered into between Lubbock County, acting by and through its duly authorized County Judge, hereinafter called "County," and the City of Lubbock, acting by and through its duly authorized Mayor, hereinafter called "City." WITNESSETH: WHEREAS, the County Commissioners' Court of Lubbock County, Texas has determined that a need exists for emergency animal con- trol services in Lubbock County outside the City limits of the City of Lubbock; and WHEREAS, the City of Lubbock agrees to furnish such services upon the terms and conditions stated below: 1. The City agrees to provide emergency animal control ser- vices, which cannot be handled by the Sheriff's Office, in Lubbock County outside the City limits of the City of Lubbock, not including incorporated areas within the County not to exceed one (1) animal control trip per month during normal working hours. 2. The City agrees to provide emergency animal control ser- vices limited to the following named circumstances: Animal Bites; Vicious Animals; Quarantine of Animals for Rabies Observation; and Vehicle Accidents Involving an Injured Animal. 3. The City in providing this service shall pay all neces- sary expenses of the personnel involved in this service from current revenues, including salaries, administration expense, fringe benefits, transportation vehicles, and the maintenance and operation of transportation vehicles. 4. The City shall provide emergency animal control service only when escorted by a deputy to the problem area. The County will be responsible for any claims of any nature whatsoever resulting from the performance of duties under this Agreement. 5. The Sheriff's Office will be responsible for filing vi- cious dog cases for prosecution by the Criminal District Attorney's Office as outlined in State Law (House Bill No. 571) passed by the 70th Legislature. 6. The term of this Contract shall be from January 1, 1988 through June 30, 1988. It is understood and agreed however that the services contracted by this Agreement may commence before the final execution of this Agreement in order to protect the health, safety and welfare of the citizens of Lubbock County. 7. A fee of $37.68 will be charged to Lubbock County for each trip outside Lubbock City limits exceeding the one (1) per month as stated in Section (1) of this Agreement. 8. This Agreement applies only to emergency calls originat- ing between 8:00 A.M. and 5:00 P.M. on weekdays. An additional fee of $5.35 will be charged for each hour or fraction thereof requiring an Animal Control Officer to respond at night, on weekends, or on a City holiday. 9. The Animal Control Section of the City Health Department will accept animals personally delivered by a Deputy Sheriff. For such animals, the Animal Control Section will kennel no more than two (2) animals per month for no more than three (3) days each free of charge. Additional animals or stays longer than three (3) days will be kept for a charge of five dollars ($5.00) per day. 10. The Animal Control Section of the City Health Department also will kennel animals picked up as a result of emer- gency calls authorized by this Agreement. For such ani- mals, the Animal Control Section will kennel no more than one (1) animal per month for no more than ten (10) days each free of charge. Additional animals or stays longer than ten (10) days will be kept for a charge of five dol- lars ($5.00) per day. 11. All fees to be paid hereunder shall be paid from current revenues of the party receiving the services. - 2 - 12. This Agreement may be amended or terminated at the re- quest of either party upon thirty (30) days written no- tice to the other party. EXECUTED this 10th.: day of December 1987.
