HomeMy WebLinkAboutResolution - 2691 - Agreement - LCC IWR - Soil Monitoring, 3 Land Application Sites - 11/19/1987JWF: j RESOLUTION Resolution #2691 November 19, 1987 Agenda Item #20 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Agreement with Lubbock Christian College Institute of Water Research whereby said In- stitute will perform soil monitoring for said City for three land applica- tion sites where treated waste water is disposed of, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Watson, Chief Water Utilities Engineer APPROVED AS TO FORM: � r C� J W rth Fullingim, Assistant Ci 6tt rney Resolution #2691 PROFESSIONAL SERVICE AGREEMENT CITY OF LUBBOCK AND LUBBOCK CHRISTIAN COLLEGE INSTITUTE OF WATER RESEARCH This professional service agreement made by and between the City of Lubbock hereinafter referred to as the Owner, and Lubbock Christian College Institute of Water Research hereinafter referred to as LCCIWR. WITNESS THAT: Whereas, the Owner is required by the Texas Water Commission to supply soil profile monitoring annually for the land application sites for wastewater disposal located on the Texas Tech University Campus, the City of Lubbock Farm, and the Hancock site near Wilson, Texas, and Whereas, the Owner desires to employ LCCIWR to perform this professional service, and Whereas, LCCIWR has proposed for and has been authorized to perform such work and receive consideration as stated herein, NOW, THEREFORE, the parties mutually agree as follows: ARTICLE I - SCOPE OF WORK LCCIWR shall furnish everything necessary, except as specified elsewhere, to perform the work described in Exhibit A. Requirements For Land Application Site Soil Monitoring. ( Reference: Exhibit A) ARTICLE II - PERIOD OF PERFORMANCE The period of this professional service agreement shall be from October 1, 1987 to September 30, 1988 and may be extended upon mutual agreement of both parties. ARTICLE III - DELIVERY All soil core samples shall be obtained before January 1, 1988. The full soil profile analyses report shall be completed and forwarded to the Owner no later than March 1, 1488. ARTICLE IV - PRICE AND PAYMENT As compensation for the performance of this agreement, the Owner agrees to pay LCCIWR a maximum amount of $21,340.65 based on work done and which shall include labor, supplies, etc. Total for Soil Sample Collection: $ 6,865.77 Total for Soil Analysis Performance: $14,474.88 Compensation per analysis: Percent Moisture $ 4.04 pH $ 3.50 Total Nitrogen $ 10.10 Total Potassium $ 31.40 Total Phosphorus $ 12.08 Conductivity $ 3.50 Total Per Sample $ 64.62 The maximum amount can be altered upon mutual agreement of both parties. If additional work is required, it shall be performed at the same rate. One invoice from LCCIWR shall be submitted to the Owner for payment upon completion of all work covered in this agreement. ARTICLE V - INCORPORATION OF STANDARD PROVISIONS LCCIWR may not make major changes in the monitoring design, schedule, method of reporting, billing, or analysis without prior notification and acceptance by the Owner. If any change causes an increase or decrease in LCCIWR's cost for the performance of this agreement, an equitable adjustment shall be made and the agreement modified. This agreement may be terminated in whole or in part in writing by either party in the event of substantial failure by the other party to fulfill its obligations under this agreement through no fault of the terminating party provided that thirty (30) days written notice of intent to terminate and an opportunity for consultation with the terminating party prior to termination is given. EXHIBIT A REQUIREMENTS FOR LAND APPLICATION SITE SOIL PROFILE MONITORING The disposal permit issued by the Texas Hater Commission requires that soil profile monitoring be performed annually for the Texas Tech University land application site located within Lubbock city limits, the City of Lubbock land application site located just east of the City of Lubbock, and the Hancock land application site located near Wilson, Texas. The soil profile monitoring shall include the following: 1. Soil Sample Collection: Collection of 29 soil core samples from the Hancock site, 29 soil core samples from the City of Lubbock site, and 4 soil core samples from the Texas Tech site. Each soil core shall be taken to a depth of 3 feet. The soil cores shall be taken at locations as determined by the City of Lubbock. Each soil core shall be separated into three subcore samples as first foot ( 0 to 1 ft, depth), second foot (I ft. to 2 ft. depth) , and third foot (2£t, to 3 ft. depth). Each soil core shall be properly identified, labeled and mapped. Each of the three samples derived from each soil core shall also be properly identified and labeled. All soil core samples must be collected before January 1, 1988. 2. Soil Sample Analysis: As required by the Texas Water Commission pH, total nitrogen, total potassium, total phosphorus, percent moisture, and conductivity analyses shall be performed on each soil sample. Requirements for Soil Profile Monitoring Page 2 All analysis methods employed shall conform to commonly accepted methods for soil analysis. All necessary quality assurance methods shall be employed and reported to ensure and justify the accuracy and dependability of all analysis results. 3.
