ORDINANCE NO.2017-00063
AN ORDINANCE ABANDONING AND CLOSING A 10-FOOT
UNDERGROUND UTILITY EASEMENT,LOCATED IN LOT 46A OF THE FALLS
AT SUNCREST ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY,
TEXAS,WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS
ORDINANCE;DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL
MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING;
PROVIDING A SAVINGS CLAUSE;AND PROVIDING FOR PUBLICATION.
WHEREAS,the City Council finds that the easement hereinafter described in the
body of this Ordinance is no longer needed for easement purposes and for public use;
and it would be in the public interest to close,vacate and abandon the same for easement
purposes and for public use;NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1.THAT the easement as hereinafter described shall BE and the same
is hereby closed,vacated and abandoned for easement purposes and for public use, such
easement being more particularly described in Exhibit "A".
SECTION 2.THAT the City Engineer is hereby authorized and directed to mark
the official maps of the City of Lubbock to reflect said abandonment and closing,
showing the number of this Ordinance and the date of its final passage.
SECTION 3.THAT should any section,paragraph,sentence,phrase,clause or
word of this Ordinance be declared unconstitutional or invalid for any reason,the
remainder of this Ordinance shall not be affected thereby.
SECTION 4.THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance as
an alternative method provided by law.
AND IT IS SO ORDERED.

FIELD NOTES FOR A 2644 SQUARE FOOT TRACT OF LAND, SITUATED ON LOT 46A,
BEING A REPLAT OF LOTS 46 & 47, CORRECTED FINAL PLAT OF THE FALLS AT
SUNCREST, AN ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, as
recorded in that certain plat, map and/or dedication deed thereof recorded
in County Clerks File #2017012008, Official Public Records of Luhhock
County, Texas (OPRLCTX) and being more particularly described by metes and
bounds as follows:
BEGINNING a 1/2" iron rod with cap inscribed "RPLS 4460" found for the
Northwest corner of this tract, from this point a 1/2" iron rod found at
the Northwest corner of said Lot 46A bears S. 89* 56' 37" W. a distance of
20.00 feet.
THENCE N. 89° 56' 37" E. a distance of 190.11 feet to a point for an "ell"
corner of this tract.
THENCE SOUTH a distance of 78.93 feet to a point in the North line of a 10
feet wide underground utility easement dedicated by plat as recorded in
Volume 9419, Page 276, for the Southeast corner of this tract.
THENCE in a Southwesterly direction around a curve to the left having a
radius of 53.00 feet, a distance of 15.46 feet to a point for a corner of
this tract, chord bearing = S. 401 27' 40" W., chord length 15.41 feet,
Delta = 16* 43' 06".
THENCE NORTH a distance of 80.65 feet to a point for an "ell" corner of
this tract.
THENCE S. 89* 56' 37" W. a distance of 180.09 feet to a point for a corner
of this tract.
THENCE North a distance of 10.00 feel to the place of BEGINNING and
containing 2644 square feet of land more or less.

Bearings are based on record bearings of the Lot 46A, The Falls at
Suncrest, an Addition to the City of Lubbock, Lubbock County, Texas as.
Distances are surface distances, U.S. Survey Feet
