AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A
STREET RIGHT-OF-WAY (STREET STUB), LOCATED ON NORTH UTICA DRIVE
IN THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS AND MORE
PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE;
DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE
CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A
SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that the street right-of-way hereinafter
described in the body of this Ordinance is no longer needed for street right-of-way
purposes and for public use; and it would be in the public interest to close, vacate and
abandon the same for street right-of-way purposes and for public use; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the street right-of-way as hereinafter described shall BE and
the same is hereby closed, vacated and abandoned for street right-of-way purposes and
for public use, such street right-of-way being more particularly described as Exhibit "A".
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark
the official maps of the City of Lubbock to reflect said abandonment and closing,
showing the number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance
as an alternative method provided by law.

METES AND BOUNDS DESCRIPTION of a 0.0215 acre portion of Utica Drive (aka North Utica Drive) as dedicated
by plat, being further described as follows:
BEGINNING at a 1/2" iron pipe found in the East right-of-way line of Utica Drive (aka North Utica Drive), dedicated
by the subdivision plat of Lots 5-22, 62-65, 144-147, 165-179, 184-197, 202-209, Unit 1, La Fiesta Estates, a
mobile home subdivision to the City of Lubbock, Lubbock County, Texas, according to the map, plat and/or
dedication deed thereof recorded in Volume 1301, Page 765 of the Deed Records of Lubbock County, Texas, for
the Northwest corner of this tract, from whence a 1/2" iron rod with cap set for the Northeast corner of said North
Utica Drive bears N. 35°04'19" W. a distance of 84.89 feet;
THENCE Northeasterly, along said East right-of-way line, along a curve to the left, said curve having a radius of
15.00 feet, a central angle of 90°00'00", tangent lengths of 15.00 feet, a chord distance of 21.21 feet and a chord
bearing of S. 80°04'19" E. to a 1/2" iron pipe found at a point of intersection for the Northeast corner of this tract;
THENCE S. 35004'19" E., continuing along said East right-of-way line, a distance of 56.00 feet to a 1/2" iron pipe
found at a point of intersection for the Southeast corner of this tract;
THENCE Southeasterly, continuing along said East right-of-way line, along a curve to the left, said curve having a
radius of 15.00 feet, a central angle of 90000'00", tangent lengths of 15.00 feet, a chord distance of 21.21 feet and a
chord bearing of S. 09°55'41" W. to a point of intersection for the Southwest corner of this tract;
THENCE N. 35°04'19" W. a distance of 86.00 feet to the Point of Beginning.
