WHEREAS, the City of Lubbock heretofore passed various street improvements, ordinances and resolutions and entered into contract with Williams and Peters Construction Company, (Project No. 9944) for the making and construction of street and/or alley improvements on portions of numerous alleys, streets and/or avenues in said City including among others the following: E -W alley between 33rd Street and 34th Street from its intersection with a line 116.5 feet west of the west property line of Avenue W to its intersection with a line 361 feet east of the east property line of Avenue X known .and designated as Sub -Unit Number 95 of Unit Number A-460. E -W alley between 7th Street and 8th Street from its intersection with the east property line of Salisbury Avenue to its intersection with the west property line of Salem Avenue known and designated as Sub -Unit Number 96 of Unit Number A-460. E -W alley between 42nd Street and 43rd Street from its intersection with the east property line of Hartford Avenue to its intersection with a line 15.9 feet west of the west property line of Gary Avenue known and designated as Sub -Unit Number 98 of Unit Number A-460. 80th Street from its intersection with a line 15 feet west of the west property line of Akron Avenue to its intersection with a line 16 feet west of the west property line of Boston Avenue known and designated as Sub -Unit Number 61 of Unit Number 2240. 80th Street from its intersection with a line 16 feet west of the west property line of Boston Avenue to its intersection with a line 16 feet east of the east property line of Elgin Avenue known and designated as Sub -Unit Number 62 of Unit Number 2240. 81st Street from its intersection with a line 16 feet west of west property line of Boston Avenue to its intersection with a line 16 feet east of the east property line of Elgin Avenue known and designated as Sub -Unit Number 63 of Unit Number 2240. t Akron Avenue from its intersection with a line 15 feet south of the south property line of 79th Street to its intersection with a line 15 feet north of the north property line of 80th Street known and designated as Sub -Unit 64 of Unit Number 2240. Akron Avenue from its intersection with a line 15 feet south of the south property line of 80th Street to its intersection with a line 15 feet north of the north property line of 81st Street known and designated as Sub -Unit Number 65 of Unit Number 2240. East 75th Street from its intersection with the east lip line of Ash Avenue to its intersection with a line 13 feet west of the west property line of Cedar Avenue known and designated as Sub - Unit Number 66 of Unit Number 2240. 76th Street from its intersection with the west lip line of Ash Avenue to its intersection with a line 13 feet east of the east property line of Avenue B known and designated as Sub -Unit Number 67 of Unit Number 2240. 77th Street from its intersection with a line 13 feet east of the east property line of Avenue B to its intersection with a line 13 feet east of the east property line of Avenue D known and designated as Sub -Unit Number 68 of Unit Number 2240. 23rd Street from its intersection with a line 13 feet east of the east property line of Juneau Avenue to its intersection with a line 5 feet west of the west property line of Iola Avenue known and designated as Sub -Unit Number 69 of Unit Number 2240. Boston Avenue from its intersection with a line 15 feet south of the south property line of 79th Street to its intersection with a line 15 feet north of the north property line of 80th Street known and designated as Sub -Unit Number 3 of Unit Number 2241. Boston Avenue from its intersection with a line 15 feet south of the south property line of 80th Street to its intersection with a line 15 feet north of the north property line of 81st Street known and designated as Sub -Unit Number 4 of Unit Number 2241. North I of Stanford Street from its intersection with the east lip line of north University Avenue to its intersection with a line 13.50 feet west of the west property line of north Avenue X known and designated as Sub -Unit Number 5 of Unit Number 2241. Rice Street from its intersection with a line 2 feet west of the east property line of north University Avenue to its intersec- tion with the west lip line of north Avenue X known and desig- nated as Sub -Unit Number 6 of Unit Number 2241. -2- r Queens Street from its intersection with a line 2 feet west of the east property line of north University Avenue to its inter- section with the west lip line of north Avenue X known and designated as Sub -Unit Number 7 of Unit Number 2241. Ash Avenue from its intersection with a line 11 feet south of the south property line of 74th Street to its intersection with a line 13 feet south of the south property line of 76th Street known and designated as Sub -Unit Number 3 of Unit Number 2242. North Avenue X from its intersection with a line 16 feet south of the south property line of Stanford -Street to its intersec- tion with a line 12.50 feet south of the south property line of Loop 289 known and designated as Sub -Unit Number 2 of Unit Number 2243. North Avenue X from its intersection with a line 16 feet south of the south property line of Rice Street to its intersection with a line 16 feet south of the south property line of Stanford Street known and designated as Sub -Unit Number 3 of Unit Number 2243. North Avenue X from its intersection with a line 16 feet south of the south property line of Queens Street to its intersection with a line 16 feet south of the south property line of Rice Street known and designated as Sub -Unit Number 4 of Unit Number 2243; and WHEREAS, the improvements upon the said portions of the above- mentioned alleys, streets and/or avenues, have been inspected and found to have been constructed in accordance with terms of said contract (Project No. 9944); NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the improvements on said portions of the above- mentioned alleys, streets and/or avenues BE and the same are hereby accepted, and the City Engineer BE and he is hereby authorized to direct final payment in the amount of $23,218.39. SECTION 2. THAT the Mayor and City Secretary BE, and they are hereby instructed to execute and deliver certificates in evidence of the assess- ments levied against the parcels of property abutting upon the said portions of the alleys, streets and/or avenues listed above and against the owners of such property in accordance with law and in the manner provided in said contract, and the proceedings with reference to said improvements and assessments where such assessments were levied. -3- ft SECTION 3. THAT this resolution shall take effect and be in force from and after its passage. Passed by the City Council this _14th day of April 1988. B. C.
