WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the widening of University Avenue, and the City Council of said
City finds it in the public interest and for public purposes and municipal
purposes to proceed with the acquisition of lands as needed for such
purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described tract
of land located in Lubbock County, Texas, be acquired for public purposes
and municipal purposes as set forth in the preamble hereof, to -wit:
Portions of Lots Six (6) and Seven (7), Doctors and Dentist
Addition to the City of Lubbock, Lubbock County, Texas,
according to the Map, Plat or Dedication Deed thereof recorded
in Volume 751, Page 162 of the Deed Records of Lubbock County,
Texas, being more particularly described as follows:
BEGINNING at a point being the Southwest corner of Lot 6 of the
Doctors and Dentist Addition to the City of Lubbock, said point
being North 87034'57.4" West, a distance of 55.00 feet from the
Southeast corner of said Lot 6;
THENCE N. 02021'32.6" East, along the West lines of Lots 6 and
7, a distance of 240.00 feet;
THENCE Northeasterly along a curve to the right having a
beginning tangent bearing N. 02021'32.6" East, and having a
radius of 15.00 feet, for a distance of 23.55 feet;
THENCE South 87°34'57.4" East, along the North line of Lot 7, a
distance of 3.00 feet;
THENCE Southwesterly along a curve to the left, having a
beginning tangent bearing North 87034157.4" West, and having a
radius of 15.00 feet, for a distance of 23.55 feet;
THENCE S. 02021'32.6" West, along a line parallel to, and 3.00
feet East of the West line of Lots 6 and 7, a distance of 225.00
feet to a point;
THENCE S. 03013'6.4" West, a distance of 15.00 feet to a point
on the South line of Lot 6;
THENCE N. 87034'57.4" West, along the South line of Lot 6, a
distance of 2.80 feet to the POINT OF BEGINNING.
SECTION 2. THAT the owners of said tract, including Raymond E. Mann
and his wife, JoAnn Mann and Robert Glen Maul and wife, Jeanne Maul, BE
offered through the Right -of -Way Department of the City of Lubbock the
amount of $9,523.18, which is the amount appraised as the value and total
damages for the fee simple title and acquisition of said real estate
hereinabove described, for the use and benefit of the City of Lubbock,
Texas, for the purposes herein stated, and unless accepted forthwith, the
City Attorney of said City of Lubbock is hereby authorized and instructed to
institute condemnation (eminent domain) proceedings to acquire the fee
simple title to said land as hereinabove described for public purposes and
municipal purposes.
