HomeMy WebLinkAboutResolution - 2020-R0432 - Extension of Benefits for Firefighter Matthew DawsonResolution No. 2020-RO432 Item No. 7.14 December 15, 2020 RESOLUTION WHEREAS, Fire Fighter Matthew Dawson ("Dawson") of the Lubbock Fire and Rescue force was critically injured while working on duty at a traffic accident on January 11, 2020; and WHEREAS, the Texas Civil Service Act provides leave for up to one year with full pay for Civil Service employees who are injured in the line of duty if they are unable to return to work due to the illness or injury, and further to extend that leave with full or reduced pay as necessary beyond the initial one year period by act of the municipality's governing body; and WHEREAS, Dawson's leave with full pay was granted by the City of Lubbock, by supplementing at thirty percent (30%) the benefit received by Dawson from Worker's Compensation, and will expire on January 11, 2021 unless extended, and as of that date Dawson will be unable to return to work for at least one additional year; and WHEREAS, the City Council of the City of Lubbock desires to extend Dawson's leave in like fashion for an additional year with full pay, pursuant to Texas Local Government Code, Section 143.073(b), or until such time that Dawson shall elect and receive benefits through a disability retirement, whichever shall first occur. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT, in recognition of Fire Fighter Matthew Dawson's valuable service to the City of Lubbock, and the severe and continuing nature of the injury he suffered in the line of duty on January 11, 2020, the City Council of the City of Lubbock does hereby extend, pursuant to Texas Local Government Code, Section 143, leave at full pay to Dawson by supplementing Dawson's Worker's Compensation benefit in an amount required to yield full pay for Dawson, for a time period ending January 11, 2022, or until such time Dawson may elect and receive benefits through a disability retirement, whichever shall first occur; and THAT, the City Manager is authorized to take all necessary actions consistent with this resolution, to effectuate its purpose. Passed by the City Council of the City of Lubbock on this, the 15th day of December, 2020.
