HomeMy WebLinkAboutResolution - 3066 - Right Of Way Offer-JB & Dorothy Stinnett-Detroit Ave Widening, L18 B1, BOH AD - 04/13/1989I� Amended by Resolution #3183 JWF: j RESOLUTION Resolution #3066 April 13, 1.989 Item #1.7 WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public purposes, to -wit: for the widening of Detroit Avenue, and this City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as afore- said; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described tract of land located in Lubbock County, Texas be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: A portion of Lot 18, Block 1, Burleson -Osborn Heights Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a 1/2" iron rod found at the Northwest corner of Lot 18, Block 1, Burleson -Osborn Heights Addition to the City of Lubbock, Lubbock County, Texas; THENCE S. 56055'20" E., along the North line of said Lot 18, a dis- tance of 61.52 feet to a railroad nail set for a point of reverse tangency;' THENCE Southwesterly around a curve to the left, said curve having a radius of 15.00 feet, a central angle of 900, tangent lengths of 15.00 feet, and a chord distance of 21.21 feet to a point of compound curva- ture from whence a railroad nail set in reference bears S. 56055'20" E., a distance of 15.00 feet; THENCE Southwesterly around a curve to the left, said curve having a radius of 190.00 feet, a central angle of 3300414011, tangent lengths of 56.42 feet, and a chord distance of 108.17 feet to a crows foot set in concrete walk in the West line of Lot 18 for a point of reverse. tangency; THENCE North, along the West line of Lot 18, a distance of 141.66 feet to the POINT OF BEGINNING. SECTION 2. THAT the owners of said tracts, including J. B Stinnett and wife, Dorothy Jean Stinnett, and J. B. Stinnett d/b/a Stinnett Food Mart, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $40,800, which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate herein- above described, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to said land as hereinabove described for public purposes and municipal pur- poses.
