HomeMy WebLinkAboutResolution - 3145 - Right Of Way Offer - EZ Hogan Jr-Detroit Ave Widening-Parts L6-12, B1, Maddox AD - 07/13/1989HW:js RESOLUTION i Resolution # 3145 July 13, 1989 "Item #18 WHEREAS, on the 26th day of January, 1989, the City Council passed Resolution No. 3023 authorizing the acquisition of additional land for mu- nicipal public uses and purposes; and WHEREAS, on the 9th day of February, 1989, the City Council passed Resolution No. 3036 authorizing the acquisition of additional land for mu- nicipal public uses and purposes; and WHEREAS, the tracts of land whose acquisition were authorized in Reso- lution No. 3023 and Resolution No. 3036 have since been resurveyed and reappraised as one single tract of land; and WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has again determined and does hereby determine that the public needs, safety and welfare demand and create a public neces- sity for the acquisition of the hereinafter described land for municipal public uses and purposes, to -wit: for the widening of Detroit Avenue, and the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of the hereinafter described land as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described tract of land located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: That portion of Lots 6, 7, 8, 9, 10, 11 and 12, Block 1, Maddox Addi- tion to the City of Lubbock, Lubbock, County, Texas, being the pro- posed right-of-way for Detroit Avenue and being further described by metes and bounds as follows: BEGINNING at the original Southeast corner of Lot 12, Block 1, Maddox Addition to the City of Lubbock, Lubbock County, Texas, for the South- east corner of this tract; THENCE N. 87030'32" W., along the South line of said Lot 12, and along the North line of Colgate Street, a distance of 32.81 feet to a 1/2" iron rod with cap marked "RPS 1974" for the Southwest corner of this tract; THENCE N. 02005'45" E., a distance of 175.00 feet to a 1/2" iron rod with cap marked "RPS 1974" in the North line of Lot 6, Block 1, Maddox Addition for the Northwest corner of this tract; THENCE S. 87030'32" E., along the North line of said Lot 6, a distance of 34.02 feet to a point for the original Northeast corner of Lot 6, and for the Northeast corner of this tract; THENCE S. 02029'28" W., along the East line of said Lots 6 through 12, a distance of 175.00 feet to the POINT OF BEGINNING. SECTION 2. THAT the owners of said tract, being E. Z. Hogan, Jr. and his wife, Linda Kay Hogan, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $27,615.00, which is the amount appraised as the real value and total damages for the fee simple title and acquisition of said real estate hereinabove described, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to ac- quire the fee simple title to said land as hereinabove described for public purposes and municipal purposes. Passed by the City Council this 13th day of July , 1989.
