RESOLUTION
RESOLUTION AUTHORIZING THE CITY MANAGER TO ISSUE NOTICE OF INTENTION
TO TERMINATE A MANAGEMENT AGREEMENT BETWEEN THE CITY AND STANDEFER & GRAY,
INC., AND TO EXERCISE CITY'S OPTION TO PURCHASE DESIGNATED FARM EQUIPMENT
AND MACHINERY WHICH IS NECESSARY FOR THE HEALTH AND SAFETY OF THE CITY IN
THE PROPER MANAGEMENT OF WASTE WATERS.
WHEREAS, the -City of Lubbock and Standefer & Gray, Inc. did enter
into a Farm Management Agreement dated September 25, 1986; and
WHEREAS, Section 24(f) authorized the City to terminate this contract
upon giving thirty (30) days written notice to the operator (Standefer &
Gray, Inc.); and
WHEREAS, the City is desirous of taking this operation into the City
and operating it accordingly; and
WHEREAS, the above mentioned contract further granted the City an
j option to purchase farm equipment and machinery in accordance with the
terms of the aforementioned contract; and
WHEREAS, said farm equipment and machinery is necessary for the
health and safety of the City of Lubbock and its residents for the proper
management of waste waters; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City Manager is hereby authorized to issue written notice of
termination of the aforementioned Management Agreement to Standefer & Gray,
Inc. at the appropriate address designated in the aforementioned Contract
of Sale.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City Manager is authorized to exercise the option granted to
the City in the aforementioned contract to purchase designated farm
implements machinery and equipment necessary for the proper management of
waste water distribution and to protect the health, safety and welfare of
the community.
