HomeMy WebLinkAboutResolution - 3214 - Declares Area Of NE Lubbock Has Unhealthy Conditions & Authorizes Service - 09/28/1989JWF:dw RESOLUTION Resblution # 3214 September 28, 1989 Item #24 WHEREAS, the City of Lubbock annexed an area northeast of the City by Ordinance No. 8025 passed on final reading on April 10, 1980; and WHEREAS, there was substantial existing development in that area at the time of annexation; and WHEREAS, substandard or non -existing water and sewer systems have been shown to constitute an extremely unhealthful condition to this densely populated area; and WHEREAS, the extension of water and sewer service is necessary to correct these extremely unhealthful conditions; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT due to the extremely unhealthful conditions which the City Council find to exist in an area (which forms a part of said annexed area) is described as follows: That area enclosed within the red line on the map attached hereto and made a part hereof as "Exhibit A" The City Council authorizes the use of all available means to address this condition, including the extension of water and sanitary sewer mains to the point shown on the attached map called Exhibit A without a deposit as required by Section 28-163 of the Lubbock City Code, providing such extension of service from the street as authorized by Section 28-151(a) of the Lubbock City Code. SECTION 2. THAT the water and sanitary sewer system serving each individual property owner and/or occupant in said area above-described is to remain a privately maintained water and sanitary sewer system, and the connection of said water and sanitary sewer system into the water and sanitary sewer system of the City of Lubbock shall in no wise place any legal obligation or duty upon the City of Lubbock to operate or maintain said private water and sanitary sewer system.
