HomeMy WebLinkAboutResolution - 3357 - Right Of Way Offer- Paul Newman & Dorothy J Newman Clark- Block 156, OT Addition - 04/26/1990HW:js RESOLUTION Resolution # 3357 April 26, 1.990 Item #15 WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisi- tion of additional land for municipal public uses and purposes, to -wit: for the Downtown Lubbock Development Program, and the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as afore- said; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described tracts ,of land located in Lubbock County, Texas be acquired for public purposes and !municipal purposes as set forth in the preamble hereof, to -wit: TRACT I BEGINNING at the Northwest corner of Lot 1, Block 156, Original Town Addition to the City of Lubbock, Lubbock County, Texas; THENCE S. 87047'24" E., a distance of 90.53 feet to a point, point being the North, Northeast corner of this tract; THENCE S. 37024156" E., a distance of 54.06 feet to a point in the East line of Lot 2; THENCE S. 020121351, W., along the East line of Lots 2 through 7, a dis- tance of 138.28 feet to a point, point being the Southeast corner of this tract; THENCE Northwesterly, along a curve to the left, having a radius of 587.96 feet and radius bearing S. 57°11'1211 W., along the Northeasterly right-of-way line of I-27, a distance of 181.15 feet to a point the West line of Lot 2; THENCE N. 02012'351, E., along the West line of Lots 1 and 2 for a dis- tance of 49.80 feet to the POINT OF BEGINNING. TRACT II BEGINNING at a point 49.57 feet N. 02012135" East of the Southwest cor- ner of Lot 11, Block 156, Original Town Addition to the City of Lubbock, Lubbock County, Texas; THENCE N. 02012,35" E., along the West side of Lots 12 through 18, a distance of 144.64 feet to a point; THENCE S. 37024'55" E., along the Southwesterly line of the P.&S.F. R.R., a distance of 196.00 feet to a point; THENCE S. 02012'381, W., along the East line of Lots 11 and 12, a dis- tance of 43.24 feet to a point being the Southeast corner of Lot ll; THENCE N. 87047124" W., along the South line of Lot 11, a distance of 97.85 feet to a point; said point being the beginning of a curve in a Northwesterly direction having a radius point that bears S. 66°15'0811 W., a distance of 587.96 feet, and an arc length of 56.54 feet to a point in the Northeasterly right-of-way line of I-27; THENCE Northwesterly along said curve to the left, and along the North- easterly right-of-way line of I-27, a distance of 56.54 feet to the POINT OF BEGINNING. SECTION 2. THAT the owner of said tracts, including Paul Newman and Dorothy Jean Newman Clark, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $8,115, which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate hereinabove described, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to insti- tute condemnation (eminent domain) proceedings to acquire the fee simple title to said land as hereinabove described for public purposes and municipal pur- poses.
