RESOLUTION

WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the widening of 34th Street, and this City Council of said City
finds it in the public interest and for public purposes and municipal
purposes to proceed with the acquisition of lands as needed for such
purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described
tracts of land located in Lubbock County, Texas, be acquired for public
purposes and municipal purposes as set forth in the preamble hereof, to -wit:

FIELD NOTE DESCRIPTION on a 122705 square feet tract of land out
of Section 44, Block A-K, Lubbock County, Texas and being more
particularly described as follows:
BEGINNING at a R.R. spike, set in the South line of said Section
44, for the Southwest and beginning corner of this tract, whence
a R.R. spike, found at the Southwest corner of said Section 44
bears North 87035,27" West, 1320.75 feet;
THENCE Forth 02018,19" East, 45.69 feet to a 3/8" iron rod,
found for a corner of this tract;
THENCE North 02012,23" East, 14.52 feet to a 1/2" iron rod, set
for the Northwest corner of this tract;
THENCE South 87047137" East, 30.00 feet to a 1/2" iron rod, set
for the P.C. of a curve to the left;
THENCE Southeasterly, along the arc of said curve, an arc
distance of 23.98 feet to a set 1/2" iron rod, said curve has a
radius of 15.00 feet, a central angle of 91*34,34", tangent
lengths of 15.42 feet, and a chord that bears South 43034,54"
East, 21.50 feet;
THENCE South 89022,11" East, 267.99 feet to a 1/2" iron rod, set
for a corner of this tract;
THENCE South 87036,04" East, 1983.83 feet to a 1/2" iron rod,
set for the Northeast corner of this tract;

FIELD NOTE DESCRIPTION on a 52649 square feet fee simple land
for slope purposes out of Section 44, Block A-K, Lubbock County,
Texas and being more particularly described as follows:
BEGINNING at a set 1/2" iron rod for the beginning corner of
this tract, whence a R.R. spike, found at the Southwest corner
of said Section 44 bears South 02'26'44" West, 83.65 feet and
North 87035,27" West, 1373.73 feet;
THENCE South 87*36,04" East, 1576.22 feet to a 1/2" iron rod,
set for a corner of this tract;
THENCE South 80*45,29" East, 251.79 feet to a 1/2" iron rod, set
for a corner of this tract;
THENCE North 87*36,04" West, 1566.07 feet to a 1/2" iron rod,
set for a corner of this tract;
THENCE North 89°22111" West, 267.99 feet to a 1/2" iron rod, set
for the P.C. of a curve to the right and a corner of this tract;
THENCE Northwesterly, along the arc of said curve, an arc

the Southwest corner of said Section 44 bears South 02026,44"
West, 83.65 feet and North 87*35,27" West, 1373.73 feet;

for the Northwest corner of this tract;

SECTION 2. THAT easement title for a drainage easement to the land
hereinafter described by metes and bounds, and respectively designated
"Tract 4" said tract of land being located in Section 44, Block A-K, Lubbock
County, Texas, be acquired for public purposes and municipal purposes as set
forth in the preamble hereof, to --wit:

DESCRIPTION on a 7800 square feet (0.179 acre) drainage easement
out of Section 44, Block A-K, Lubbock County, Texas and being
more particularly described as follows:
BEGINNING at a 1/2" iron rod set in the North line of a 15 feet
wide fee simple tract of land for ditch purposes hereinabove
referred to as Tract 3 for the Southeast and beginning corner of
this easement, whence the Southeast corner of Section 44, Block
A-K bears South 02024,33" West, 98.79 feet and South 87"35127"
East, 3103.24 feet;
THENCE North 02*23,156" East, 130.00 feet to a 1/2" iron rod set
for the Northeast corner of this easement;
THENCE North 87036,04" West, 60.00 feet to a 1/2" iron rod set
for the Northwest corner of this easement;

THENCE South 02023,56" West, 130.00 feet to a 1/2" iron rod set
in the North line of said 15 feet wide fee simple tract of land
for ditch purposes hereinabove referred to as Tract 3 for the
Southwest corner of this easement;
THENCE South 87036,04" East, along the North line of said 15
feet wide fee simple tract of land for ditch purposes
hereinabove referred to as Tract 3, 60.00 feet to the POINT OF
BEGINNING.
CONTAINING: 7800 square feet (0.179 Acres).
SECTION 3. THAT the owners of said tract, being Mina Wolf Lamb, Arch
Karl Lamb, and Arch G. Lamb, BE offered through the Right -of -Way Department
of the City of Lubbock the amount of $80,034.00, which is the amount
appraised as the value and total damages for the fee simple title and
acquisition of said real estate hereinabove described, and the amount of
$179.00 for the easement title to the real estate hereinabove described for
the value and damages therefore, being a total offer to said owner of
$80,213.00 for such fee simple and easement title acquisition, for the use
and benefit of the City of Lubbock, Texas, for the purposes herein stated,
and unless accepted forthwith, the City Attorney of said City of Lubbock is
hereby authorized and instructed to institute condemnation (eminent domain)
proceedings to acquire the fee simple title and easement title to said land
as hereinabove described for public purposes and municipal purposes.
