HomeMy WebLinkAboutResolution - 3545 - Amend Board & Commission Attendance Policy - 02/14/1991DGV:da RESOLUTION Resolution No. 3545 February 14, 1991 Item #20 WHEREAS, the City Council of the City of Lubbock believes it to be in the best interest of the citizens of the City of Lubbock to further define the City of Lubbock's policy with regard to attendance of City board and commission members; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Manager of the City of Lubbock is hereby authorized and directed pursuant to Resolution No. 1610 (1984) to place the policy attached hereto and incorporated herein for all intents and purposes into Volume 1 and Volume 2 of the City of Lubbock's Policies and Procedures Manual. Van -diver, First Assistant City Attorney resolution 1610 - 3/8/84 DGV:da RESOLUTION WHEREAS, the City Council of the City of Lubbock has from time to time had occasion to establish policies and procedures pertaining to the operations of the City of Lubbock as a governmental entity; and WHEREAS, the City Manager of the City of Lubbock has from time to time had occasion to establish policies and procedures pertaining to the internal administration of the City of Lubbock; and WHEREAS, such policies and procedures, many of which are embodied in unpublished resolutions and internal memos, should be embodied in a Policies and Procedures Manual, which manual should be available to the public, the City Council and city officials in an easily usable form; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the City Manager of the City of Lubbock is hereby authorized and directed to consolidate City of Lubbock policies and procedures into a City of Lubbock Policies and Procedures Manual. SECTION 2. THAT volume one of the said Manual shall contain policies and procedures that City employees follow when dealing with private citizens, companies or corporations and other governmental bodies, which volume shall be updated as required upon change of existing policies or procedures or enactment of new policies or procedures by the City Council. Said volume shall be kept available for inspection during all normal hours of operation of the City of Lubbock. SECTION 3. THAT volume two of the said Manual shall contain policies and procedures pertaining to the internal administration of the City of Lubbock promulgated by the City Manager of the City of Lubbock, which volume shall be updated as required upon change of existing policies or procedures or establishment of new policies or procedures by the City Manager. Said volume shall be kept available for inspection during all normal hours of operation of the City of Lubbock. SECTION 4. THAT a copy of this Resolution shall be placed in each volume of the City of Lubbock Policies and Procedures Manual. Resolution No. 3545 REPLACEMENT OF BOARD AND COMMISSION MEMBERS OBJECTIVE: To define excused and unexcused absences; to establish criteria for forfeiture of appointment; to establish procedures for recording and maintaining records of absences, agendas and minutes of respective boards. RESPONSIBLE AGENCY: City Secretary and City Manager's Representative SERVICE/POLICY: An absence may be excused for the following reasons: illness, emergency occurrences (death in family, hospitalization), jury duty, being out-of-town for business reasons. Absences due to military assignment shall be considered by the City Council on a case-by-case basis. Absences for any other reason shall be unexcused. Previous commitments that prevent attendance at specially called meetings on other than the regular scheduled meeting day may be excused. An appointee who has three consecutive unexcused absences or who for any reason is absent from 50% of the regular board/commission meetings during a calendar year, automatically forfeits his/her appointment as of the date that the 50th percentile meeting is missed. The staff liaison shall submit written notification of the vacancy to the City Secretary, who shall place an item on the agenda of the next meeting of the City Council for appointment of a replacement to serve the remainder of the unexpired term. An agenda of each meeting shall be posted in accordance with the Open Meetings Law, and agendas, minutes and attendance records of the entire board shall be timely filed with the City Secretary. All board/commission records shall be maintained in accordance with the Local Government Records Act. The above information shall be subject to the rules and regulations of the Open Records Act. CITY COUNCIL RELATIONS WITH STAFF OBJECTIVE: To define the City Council's relationship with the City Manager and members of the City staff. -RESPONSIBLE AGENCY: City Council SERVICE/POLICY: In accordance with Article X, Section 6 of the City Charter in Chapter 1 of the City of Lubbock's Code of Ordinances, the governing body shall hold the City Manager responsible for the proper administration of all affairs of the City. The City Manager or his designated representative is responsible for the appointment and removal from office of all City employees unless the City Charter specifically assigns this responsibility to the governing body. The City Manager is the Chief Executive Officer of the City. The City Council charges the City Manager with carrying out their policies and directives. The City Manager is responsible for implementing City Council policies by planning, organizing and directing the activities of the City Staff. The City Charter of the City of Lubbock stipulates that the members of the governing bodies should defer to the City Manager the responsibility of directing the activities of the City Staff. However, the City Charter allows the members of the governing body to make inquiries about the City's policies and procedures with City Staff. The City Staff member should immediately advise his supervisor and the City Manager's Office concerning the nature of the inquiry and to request assistance in responding to the request. The members of the governing body should address all other questions and requests through the City Manager or his designated representative. City Staff shall not be requested nor shall th sona , private or political tasks tor members_ Council. 3 --y-g'�Z, e orm oer- r - ( City Council Relations With Staff Page 2 City Staff members are not allowed to address the City Council concerning matters which immediately affect their specific department or concerning matters which immediately affect his status as an employee of the City of Lubbock. Adequate proce- dures do exist for the expression of appeals and grievances and these items would be more appropriately referred to department heads and immediate supervisors.
