HomeMy WebLinkAboutResolution - 2020-R0414 - Amendment 1 to Contract 14190 with Randall Scott Architects, Inc.Resolution No. 2020-RO414 Item No. 7.8 December 1, 2020 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock, Amendment No. 1 to Contract No. 14190, for architectural services for the Public Safety Improvement Project, Municipal Courts Facility, by and between the City of Lubbock and Randall Scott Architects, Inc., and related documents. Said Amendment is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. THAT the City Council finds it to be in the best interest of the citizens of the City of Lubbock in order to expedite the performance of city business, to delegate authority to execute any future amendments, the value of which individually shall not exceed $50,000, for changes to the scope of services along with associated costs and savings for Contract 14190, to the City Manager of the City of Lubbock. THIS IS THE FIRST AMENDMENT TO THE AGREEMENT dated and entered into the 9th day of April 2019 by and between the City of Lubbock ("City") and Randall Scott Architects, Inc. ("RSA"), 2140 Lake Park Blvd. Suite 300, Richardson, Texas 75080. RSA entered into the Agreement with the City for performing professional services relating to the design, plans and specifications for Public Safety Improvement Project, Municipal Courts Facility. The Agreement, Contract No. 14190 was approved by City Council on April 9, 2019, Resolution No. 2019- R0126. Amendment 1 includes additional professional services as stated in Attachments A and B, attached and incorporated herein, which include the following services: ASP #1 Additional Services Proposal (ASP #1) -- Additional civil and structural engineering (Attachment A) fees to include paving the alley and replacing a portion of roof. Amount for services relating to Attachment A is $6,750. ASP #2 Additional Services Proposal (ASP #2) - Additional structural engineering fees (Attachment B) associated with existing, unforeseen building conditions. Amount for services relating to Attachment B is $9,500. Further, RSA warrants that it complies with Chapter 2270, Subtitle F, Title 10 of the Texas Government Code by verifying that: (1) RSA does not boycott Israel; and (2) RSA will not boycott Israel during the term of the Agreement. All other portions of the original Agreement and previous Amendments, if any, shall remain in place and are not altered by this amendment. INTERIORS I PLANNING October 14, 2020 Mr. Darren Densford City Architect City of Lubbock Citizen's Tower, 1314 Avenue K Lubbock, TX 79401 RE: ASP #1 - A/E Services for Modifications to East Alley Lubbock Municipal Court Expansion & Renovation Darren, As requested, we are submitting this Additional Services Request #1 to field verify and make changes to the civil and structural drawings on the Municipal Court 100% Construction Documents. The scope of work consists of changes requested by the City to the paved alley east of the Municpal Court and design of roof replacement that needs to be designed adjacent to the emergency generator enclosure. Scott, AIA Founding Principal APPROVED City of Lubbock Date ATTACHMENT B RANDALL SCOTT ARCHITECTS ARCHITECTURE ; INTERIORS I PLANNING October 14, 2020 Mr. Darren Densford City Architect City of Lubbock Citizen's Tower, 1314 Avenue K Lubbock, TX 79401 RE: ASP #2 — Additional Structural Engineering Fees for Lubbock Municipal Court Expansion & Renovation Darren, Rusty Thoma of Thoma Engineers contacted me recently requesting additional services fees on the Lubbock Municipal Court project and I believe his request has merit. When the design team provided our original fee proposal, the current design had not been developed. The structural scope was very difficult to anticipate. Rusty and RSA anticipated a scope of work that seemed reasonable at the time in terms of setting the structural fees. Truthfully, neither of us expected the structural work to be significant so their fees were relatively low. As the design progressed, the entry portals and large storefront windows were introduced to reflect the Citizen's Tower DNA. This required much of the exterior wall to be removed and replaced in addition to beefing up structure under the RTU's, slab removal and replacement at the west storefront, and other structural work for which little or no structural as -built information was available. Thoma's work has ballooned to more than twice what was originally envisioned. On behalf of Thoma Engineers, I am requesting an additional $9,500 in structural engineering fees which, while it will not make them whole, will certainly help reduce their losses on the project. In spite of their losses, Thoma Engineering has done everything we asked, which is very admirable. In the interest of helping Thoma recover as much of their losses as possible, RSA is not asking for our normal 10% markup on their additional services fees. The City's thoughtful consideration in taking care of one of its high quality local businesses is greatly appreciated.
