BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock Change Order No.
1 adding paving quantities to Project No. 9403 (1990 Assessment Paving Pro-
gram, 34th Street from West Loop 289 to Milwaukee Avenue) to an existing
Contract for paving improvements between said City and C. B. Thompson Con-
struction Company, attached herewith, which shall be spread upon the minutes
of the Council and as spread upon the minutes of this Council shall constitute
and be a part of this Resolution as if fully copied herein in detail.

1990 ASSESSMENT PAVING PROGRAM (34TH STREET FROM WEST LOOP 289 TO
MILWAUKEE AVENUE)
TO: C.B. Thompson Construction Co.

Gentlemen:
WHEREAS, it is desirable to make changes in the plans and
specifications for this project, being namely the addition of the
following:
Sidewalk Removal and Replacement
Curb and Gutter Removal and Replacement
Changes to Storm Sewer Design
WHEREAS, the Contractor herein agrees to the following change:
Original Amount of Contract $1,299,881.95
Increased by Change Order No. 1 82,026.87
Total Amount of Contract $1,381,908.82
30 Additional working days is allowed with this Change Order.
THIS AGREEMENT WITNESSETH: In consideration of the mutual
advantages gained, the Owner and the Contractor agree to the change
shown herein and in the revised plans, the Owner agrees to pay the
Contractor the amount of increase in cash. The Contractor agrees to
proceed with construction and to adhere to applicable specifications,
under the direction of the Engineer. Furthermore, the parties agree
that the original contract between the Owner and the Contractor shall be
modified to the extent herein indicated, including one (1) attachment.
IN WITNESS WHEREOF, the Owner and the Contractor have hereto set
their hands this 22nd day of October , 1991.

Re: 34th Street Reconstruction
Drainage Modifications
Dear Larry:
October 14, 1991
We have received, reviewed and evaluated the additional package of information
furnished by Midwest Concrete to document costs associated with the changes to
the drainage system on West 34th Street as a result of conflict with a telephone
duct bank. Our evaluation has resulted in the identification of a recommended
response to the Contractor concerning his request.
The Contractor has requested a total of $77,628.61 for the modifications. The
following revisions to the Contractor's request appear to be in order. The six
percent (6%) increase on each item is the Contractor's mark-up for Thompson and
bond.
I. The Contractor's records list pipe laying prices as follows.

2. The Contractor's Change Request lists pea gravel at $13,500 x 1.06 —
$14,310. The backup provided indicates a total of 615 cubic yards at
$13.50 per cubic yard or $8,302 x 1.06 a $8,800. It appears that a
reduction of $14,310 - $8,800 — $5,510 is appropriate.
3. We understand that Midwest has already agreed to delete the amount of
$9,500 x 1.06 — $10,070 for Midwest markup on Weaver items.
The revisions listed above are summarized as follows:

We have used the information provided by the Contractor, the backup to his
original bid, as well as his current change request in making our evaluation and
recommendations. A summary of the change request and our recommendations
