HomeMy WebLinkAboutResolution - 4028 - Amendment To Agreement - MEC Inc - Power Lines, 2 Tracts Of Land - 12/10/1992Resolution No. 4028 December 10, 1992 Item #5 RESOLUTION WHEREAS, under Resolution No. 3539 of the City of Lubbock passed on February 14, 1991, the City Council of the City of Lubbock granted to Midwest Electric Cooperative, Inc., a Texas Cooperative Corporate Public Utility Com- pany (as Permittee) an Electric Power Lines Land Use Permit Agreement to lay, construct, repair, maintain, or remove, and use underground and overhead power lines, poles, guy wires, transformers, and all other related electrical power lines, fixtures, substations and equipment in, upon, over, under, along and across certain real estate as therein described which real estate is owned by the City of Lubbock; and WHEREAS, said Midwest Electric Cooperative, Inc. has requested that said Permit Agreement be extended and amended by adding two (2) additional tracts of real estate owned by the City of Lubbock to be made a part of the operation and terms of said Permit Agreement as hereinafter described; and WHEREAS, the City Council of the City of Lubbock finds and determines that it would be in the public interest to grant such request; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the grant of the aforesaid Permit Agreement is hereby extended and amended to include within its operations and terms, two (2) new additional tracts of land known and described as the Southeast Quarter of Section 106 and the Southwest Quarter of Section 95, both in Block 5, H.&G.N. RR. Co. Survey, Garza County, Texas. SECTION 2. THAT Midwest Electric Cooperative, Inc. agrees that the placing and locating of its facilities, as aforesaid, within any part of each said two (2) new additional tracts described in Section 1, hereof, shall oper- ate as an acceptance of this extension and amendment to said Permit Agreement, and the operation and terms of said Permit Agreement shall apply to the two (2) new additional tracts owned by thqwCfiCy' Lubbock after such acceptance.
