HomeMy WebLinkAboutOrdinance - 2020-O0149 - Amending Chapter 40 of the Code of Ordinances, Downtown ParkingFirst Reading Second Reading October 27, 2020 November 2, 2020 Item No. 7.12 Item No. 7.12 ORDINANCE NO. 2020-00149 AN ORDINANCE AMENDING CHAPTER 40 "ZONING" OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO ARTICLE 40.03 "DISTRICTS" AND PARKING REQUIREMENTS IN DOWNTOWN LUBBOCK; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY; AND PROVIDING FOR PUBLICATION. WHEREAS, at the January 28, 2020 work session of the City Council of the City of Lubbock, the City Council heard a presentation by Overland Partners, Inc. ("Overland") regarding the Downtown Master Plan Update (the "Plan"); and WHEREAS, as a part of the Plan, Overland made specific findings and proposed its recommendations to the City Council regarding parking in Downtown Lubbock; and WHEREAS, the recommendation from Overland was to adjust existing, required parking ratios for Downtown Lubbock developments, as Overland determined the existing parking supply accommodates the current and future demands of existing and ongoing development in Downtown Lubbock; and WHEREAS, the Planning and Zoning Commission of the City of Lubbock, Texas (the "Commission"), during its meeting on October 1, 2020, found that it is in the best interest of the citizens of Lubbock to amend the Downtown Lubbock parking requirements within Chapter 40 of the code of Ordinances of the City of Lubbock; and WHEREAS, the Commission recommends that the City Council of the City of Lubbock, Texas amend Chapter 40 of the City of Lubbock Code of Ordinances as amended below; and WHEREAS, the City Council of the City of Lubbock deems it to be in the best interests of the health, safety and welfare of the citizens of the City of Lubbock to make the following amendments to the Code of Ordinances of the City of Lubbock, Texas in consideration of the analysis performed by, and recommendation of, Overland; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK; SECTION 1. THAT Section 40.03.1761(a) shall be amended to read as follows: (a) Off-street parking —Requirements. (1) Boarding or rooming houses - One space for every two (2) occupants. (2) Churches and other places of worship — One (1) paved space for each eight (8) seats in the auditorium. If pews are used, each twenty (20) inches in length shall equal one seat. (3) Convalescent, nursing, maternity and geriatric homes and personal care facilities - One and a half (1.5) spaces for each five (5) beds. (4) Day nurseries - One (1) space for each six hundred (600) square feet of gross floor area. (5) Funeral home or mortuary One (1) space for each eight (8) seats in the chapel. (6) Hospital - One (1) space for each bed. (7) Residential units - One (1) space for each efficiency unit, one and one-half (1- 1/2) spaces for each one (1) bedroom unit, two (2) spaces for each unit with two (2) or more bedrooms, plus one (1) additional space for each four (4) units in the development. Townhomes, garden homes, duplexes, and single family shall comply with the "R-1," "R-1 A," and "R-2" parking standards. Residential parking standards shall be calculated using these methods, and applicant may request to reduce required spaces by one-half. (8) Restaurants — One (1) space for each two hundred (200) square feet of gross floor area, except that outside dining areas/patios with fewer than two hundred fifty (250) square feet shall not be included in the gross square footage. Any outside dining areas/patios larger than two hundred fifty (250) square feet shall have the entire area included in the gross square footage. (9) Semi-public uses such as YMCA, YWCA, scouts, boys and girls club, etc. - One space for each one thousand (1,000) square feet in activity areas such as gymnasium or swimming pools plus one (1) space for each four hundred (400) square feet of other building areas. (10) All permitted uses not listed above — One (1) space for each six hundred (600) square feet of floor area. (11) Conditional uses - The required number of spaces shall be set by the zoning board of adjustment, based on the requirements for that use or similar type uses in this or other districts. (12) Any brewpub, microbrewery, microdistillery, microwinery, wine tasting facility, beer tasting facility, or alcohol tasting facility shall not be required to provide off-street parking. SECTION 2. THAT Section 40.03.1882(a) shall be amended to read as follows: (a) Off-street parking requirements. (1) Boarding or rooming houses - One (1) space for every two (2) occupants. (2) Churches and other places of worship - One (1) space for each eight (8) seats in the auditorium. If pews are used, each twenty (20) inches in length shall equal one seat. E (3) Convalescent, nursing, maternity and geriatric homes and personal care facilities - One and a half (1.5) spaces for each five (5) beds. (4) Day nurseries - One (1) space for each six hundred (600) square feet of gross floor area. (5) Funeral home or mortuary — One (1) space for each eight (8) seats in the chapel. (6) Game rooms, pool, billiard and/or domino parlors — One (1) space for each one hundred (100) square feet of gross floor area. (7) Hospital - One (1) space for each bed. (8) Nightclub, bar, lounge, or dance hall. One space for each two hundred (200) square feet of gross floor area. (9) Residential units - One (1) space for each efficiency unit, one and one-half (I- 1/2) spaces for each one (1) bedroom unit, two (2) spaces for each unit with two (2) or more bedrooms, plus one (1) additional space for each four (4) units in the development. THAT Section 40.03.2162(a) shall be amended to read as follows: (a) Off-street parking requirements. (1) Churches and other places of worship. One (1) space for each eight (8) seats in the auditorium. If pews are used, each twenty (20) inches in length shall equal one seat. (2) Clinic, medical. One (1) space per four hundred (400) square feet of gross floor area. (3) Day nurseries - One (1) space for each six hundred (600) square feet of gross floor area. (4) Funeral home or mortuary. One (1) space for each eight (8) seats in the chapel. 6 (5) Hospital - One (1) space for each bed. (6) Hotels and motels. Two (2) spaces for each three (3) units, plus one (1) space per two hundred (200) square feet of incidental or accessory uses based on the square footage devoted to those uses. Applicant may request to reduce required spaces by one-half. (7) Loft apartment. One (1) space for each efficiency unit, one and one-half (1-1 /2) spaces for each one (1) bedroom unit, two (2) spaces for each unit with two (2) or more bedrooms, plus one (1) additional space for each four (4) units in the development. Residential parking standards shall be calculated using these methods, and applicant may request to reduce required spaces by one-half. (8) Nightclub, bar, lounge, or dance hall. One (1) space for each two hundred (200) square feet of gross floor area. (9) Performing arts center. One (1) space per eight (8) seats. (10) Restaurants - One (1) space for each two hundred (200) square feet of gross floor area, except that outside dining areas/patios with fewer than two hundred fifty (250) square feet shall not be included in the gross square footage. Any outside dining areas/patios larger than two hundred fifty (250) square feet shall have the entire area included in the gross square footage. (11) Semi-public uses such as YMCA, YWCA, scouts, boys and girls club, etc. - One space for each one thousand (1,000) square feet in activity areas such as gymnasium or swimming pools plus one space for each four hundred (400) square feet of other building areas. One (1) space for each efficiency unit, one and one-half (1-1 /2) spaces for each one (1) bedroom unit, two (2) spaces for each unit with two (2) or more bedrooms, plus one (1) additional space for each four (4) units in the development. Residential parking standards shall be calculated using these methods, and applicant may request to reduce required parking by one-half. (3) Performing arts center. One (1) space per eight (8) seats. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 8. THAT violation of any provision of this Ordinance shall be a misdemeanor punishable in accordance with state law and Section 40.01.006 of the Code of Ordinances of the City of Lubbock. SECTION 9. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication as provided by law.
