HomeMy WebLinkAboutResolution - 4563 - Supplemental Agreement #3- HDR Engineering Inc- Data Colection, Landfill Project - 07/28/1994Resolution No. 4563 Item #25 July 28, 1994 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Supplemental Agreement No. 3 to the City of Lubbock Landfill Site Selection and Permiting Agreement of October, 1992, by and between the City of Lubbock and HDR Engineering, Inc., modifying the expenses for engineering services necessary for the collection of data required for the landfill permitting application required by the TNRCC. Said Supplemental Agreement No. 3 is attached hereto and shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. ENGINEER FOR PROFESSIONAL ENGINEERING SERVICES FOR THE LANDFILL SITE SELECTION AND PERMITTING PROJECT JULY 28. 1994 SUPPLEMENTAL AGREEMENT NO. 3 TO THE AGREEMENT DATED OCTOBER 8, 1992 BETWEEN CITY OF LUBBOCK, TEXAS OWNER AND HDR ENGINEERING, INC. ENGINEER FOR PROFESSIONAL ENGINEERING SERVICES FOR THE LANDFILL SITE SELECTION AND PERMITTING PROJECT THIS IS SUPPLEMENTAL AGREEMENT NO. 3 made as of July 28, 1994 between the City of Lubbock, Texas and HDR Engineering, Inc. for modifications to the AGREEMENT BETWEEN CITY OF LUBBOCK, TEXAS AND HDR ENGINEERING, INC. FOR PROFESSIONAL ENGINEERING SERVICES dated October 8, 1992. OWNER and ENGINEER, in consideration of the mutual covenants contained herein, agree to modifications to the Agreement as follows: Change the Agreement Section Attachment C - Paragraph A - Phase II - Work Element C to read; The maximum billed for these Engineering Services shall not exceed $466,410. In addition, Engineer's and Subcontractor's reimbursable expenses are estimated to be $376,300. The fee schedule for the Engineer's services is presented in Paragraph E. 2. Replace Supplemental Agreement No. 1, dated December 9, 1993 Attachment A - Phase II - Scope of Services - Project Assumptions - 5th Paragraph with the following: A total of 68 borings will be used to describe the geologic and hydrogeologic conditions at the proposed landfill site. These borings will include five of the May 1993 borings and an additional seventy six borings. Thirty of these borings will be advanced to a depth of at least five feet below the elevation of the deepest excavation at the site. Fifteen borings, with a minimum depth of 30 feet below the elevation of the deepest excavation at the site will be advanced to the base of the Ogallala Formation, the top of the saturated zone in the Ogallala, or into shallower perched water -bearing zones in the Ogallala, whichever is encountered first. Borings terminating in perched water -bearing zones will be converted into two-inch diameter piezometers. Three borings will penetrate through the Ogallala Formation and Edwards Limestone and into the underlying Triassic shale, which serves as an aquiclude. The remaining fifteen of these borings will be advanced deep into the saturated zone of the Ogallala Formation and converted into two or four -inch diameter piezometers. All of the piezometers will be utilized in the site groundwater characterization study. All boring locations will be surveyed by a licensed surveyor. 3. Add the following assumptions. Any borings that are drilled into the limestone may encounter crevices and or caverns, which will increase the cost of the project. Any additional piezometers required caused by the discovery of perched zones will increase the cost of the project. Except as modified herein, all other provisions of the Agreement remain unchanged.
