Said Amendment is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Low Head B and Reese Pipeline September 24, 2020 Resolution No. 2020-R0358 Amendment 1 To Agreement Between The City of Lubbock, TX And Freese and Nichols, Inc. THIS IS THE FIRST AMENDMENT TO THE AGREEMENT, Contract No. 14121, dated and entered into the 28th day of June 2018 by and between the City of Lubbock ("City") and Freese and Nichols, Inc. ("Engineer"), a Texas Professional Corporation, for providing engineering services related to the Demolition of Pump Station 7, Low Head B, and the Reese Pipeline ("Project'). WITNESSETH: WHEREAS, the City desires to increase the scope of the work to be performed by Engineer on the Project. The new scope shall include: final design services, waterline replacement modifications, and construction materials testing. The details of work to be performed and associated additional fees are described in Exhibits A-B, Part 2, attached to and incorporated herein. The additional services shall be provided for an amount not exceed $74,530.00 The term of the contract shall be extended an additional 180 days for the performance of these additional services. WHEREAS, all other portions of the original Agreement and previous Amendments, if any, shall remain in place and are not altered by this amendment. By: Nr c� de/yu Nick Lester, P.E., Vice President/Principal Amendment 1 — Contract 14121 EXHIBIT A AMENDMENT NO. 1 SCOPE OF SERVICES FOR: DEMOLITION OF PUMP STATION 7, LOW HEAD B AND THE REESE PIPELINE FINAL DESIGN and CONSTRUCTION REPRESENTATION GENERAL: A. Amendment for City of Lubbock Professional Service Agreement Contract No. 14121 for Demolition of Pump Station 7, Low Head B and the Reese Pipeline (The "Project") includes the project administration, design modifications and finalization for the Demolition of Pump Station 7 and Waterline Replacement Bid Package. B. The following facilities are not part of the Project. If added to the Project, this Agreement may be amended to provide such facilities, and additional compensation may be granted to Engineer therein. 1. Design of Demolition of the Electrical substations or power transmission lines at the Pump Station 7 site. 2. Additional Asbestos Survey of the Low Head B Pump Station (Limited Asbestos Survey was conducted at the Low Head B Pump Station August 2011). BASIC SERVICES: The Basic Services include the project administration, finalization of detailed design and construction documents, Construction bid and award services as set forth herein. Engineer sometimes referred to as "FNI" shall render the following professional services in connection with the development of the Project Amendment: A. GENERAL SCOPE OF SERVICES TASKS: ENGINEER will provide the following as part of the final design phase of The Project: 1. Provide administration and managements of The Project. Review ongoing activities. Monitor schedule and budget. Review progress with OWNER on a regular basis. Discuss issues with the OWNER as they are noted. 2. Provide monthly update reports which include the following: Page 1 of 5 *Status of the work •Major tasks to be completed in the next month *Discussion of major issues *Scope changes to project scope or Engineer's scope *Project budget update (if major changes since the last update) *Project schedule update (if major changes since the last update) •Status of deliverables B. LOW HEAD B DESIGN FINALIZATION: FNI shall provide professional services in this phase as follows: 1. Prepare plans, specifications, contract documents, designs, and layouts of improvements to be constructed. 2. Submit plans, specifications, and contract documents to the applicable federal and state agency(s) for approval, where required. Submittals will include TCEQ if required. 3. Furnish necessary information to utility companies whose facilities may be affected, or services may be required for the Project. Provide site civil design of the pump station sites to support the electric utilities site requirements for the demolition. 4. Level 3 Review: Furnish OWNER five (5) copies of preliminary (100%) Demolition of Low Head B Bid Package plans, specifications, and bid proposals marked "Preliminary" for approval by OWNER. ENGINEER will meet with the OWNER to present the preliminary plans and specifications. After OWNER'S review, ENGINEER will meet with OWNER to receive comments. Upon final approval by OWNER, ENGINEER will complete the plans and specifications and provide OWNER five (5) sets of copies of "Final" plans and specifications. Level 3 Review documents will include all drawing sheets and specifications with some minor corrections and notes still remaining. 5. Prepare bidder's proposal forms (project quantities) of the improvements to be constructed. 6. Prepare revised opinion of probable construction cost at the Level 3.Review. C. PS7 WATERLINE REPLACEMENT MODIFICATION: FNI shall provide professional services in this phase as follows: 1. Design and prepare Field Order for replacement of existing 42-inch pipeline in front of Pump Station 7 in the Marsha Sharp frontage road, from the existing gate valve in the PS7 site to the 24-inch isolation valve that cuts of the Grace Clinic line before it crosses under Marsha Sharp. Page 2 of 5 D. PS7 CONSTRUCTION MATERIALS TESTING 1. Soil a) D698 proctors — Every 500 LF native - 3 total b) D1557 proctors —1 total c) Nuclear density testing — Approximately 12 per day. Testing will be performed as directed by the RPR. Approximately 5 days with technician time of 4-6 hours per day. 2. Embedment Material a) ASTM D 4253 Proctor-1 sample per source. 3 total as needed. b) Dry gradation — 2 total as needed. c) 5-cycle magnesium soundness — 2 total as needed d) L.A. Abrasion — 2 total as needed e) Atterberg limits of fines — 2 total as needed f) Resistivity — 2 total as needed 3. Page 3 of 5 EXHIBIT B, PART 1— BUDGET AMENDMENT NO. 1 DEMOLITION OF PUMP STATION 7, LOW HEAD B AND THE REESE PIPELINE FINAL DESIGN and CONSTRUCTION REPRESENTATION CITY and ENGINEER have established a not -to -exceed budget. of $74,530.00 to complete all services under this AGREEMENT. This amount will not be exceeded without a contract amendment agreed upon and executed by both parties to this agreement. CITY will pay the ENGINEER hourly, for services identified in Exhibit A, Part 1, based on ENGINEERS Fee Schedule presented as EXHIBIT B, Parts 1-2. Subconsultant services will be billed at cost to ENGINEER with a 10 percent handling fee. The Budget is presented for the services of ENGINEER under this AGREEMENT is provided in this Exhibit B. CITY and ENGINEER agree to allow redistribution of funds between Activities as appropriate to allow flexibility in providing the needed services within the not -to -exceed budget. ENGINEER agrees to complete these services as delineated above. Should there be a Change in Scope of Work or Time of Performance, then this can result in an amendment or modification for extension of time to this agreement which shall be negotiated at that time. The budget assumes that all work will be completed within 180 calendar days from the Notice to Proceed. If FNI sees the Scope of Services changing so that Additional Services are needed, including but not limited to those services described as Additional Services in Attachment SC, FNI will notify OWNER for OWNER's approval before proceeding. They include outside printing and reproduction expense, communication expense, travel, transportation and subsistence away from the FNI office and other miscellaneous expenses directly related to the work, including costs of laboratory analysis, test, and other work required to be done by independent persons other than staff members. For Resident Representative services performed by non-FNI employees and CAD services performed In-house by non-FNI employees where FNI provides workspace and equipment to perform such services, these services will be billed at cost times a multiplier of 2.0. This markup approximates the cost to FNI if an FNI employee was performing the same or similar services. LUB18411 City of Lubbock PSA Contract No. 14121 DATE: 8/31/2020 Amended Deliverables: Additional bid package for Demolition of Low Head B and as defined in the attached proposal. Original contract included one bid package. Demolition of Low Head B has been broken out of the Demolition of Pump Station 7 Bid Package. Amendment also includes construction materials testing for the Demolition of Pump Station 7 Bid Package. Amended Schedule: The proposed amendment adds 180 days to the contract amendment dated June 26th 2020, to cover the duration of construction of the Demolition of Pump Station 7 Bid Package. Revised end of contract would be June 25, 2021. Compensation shall be amended as follows: A not -to -exceed budget amount of Seventy -Four Thousand Five Hundred Thirty Dollars ($74,530).
