RESOLUTION
BE IT RESOLVED BY THE +CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to
execute for and on behalf of the City of Lubbock Amendment No. 5 (TDH Document No.
06000126) and all related documents by and between the City of Lubbock and the Texas
Department of Health to add a new Attachment for Bureau of HIV and STD to fund the
initiation/implementation of an early intervention medical treatment and psychosocial services
program for HIV-positive individuals, which contracts is attached hereto, which shall be spread
upon the minutes of the Council and as spread upon the minutes of this Council shall constitute
and be a part of this Resolution as if fu��herein in detail.

The Texas Department of Health, hereinafter referred to as RECEIVING AGENCY, did
heretofore enter into a contract in writing with
LUBBOCK CITY HEALTH DEPARTMENT
hereinafter referred to as PERFORMING AGENCY. The parties thereto now desire to
amend such contract as follows:
SUMMARY OF TRANSACTION:
Revision to public health services contract.
Att. No. 08 - Amendment to add a new Attachment for Bureau of HIV and STD to
fund the initiation/implementation of an early intervention
medical treatment and psychosocial services program for HIV-
positive individuals.
All terms and conditions not hereby amended remain in full force and effect.

PERFORMING AGENCY: LUBBOCK CITY HEALTH DEPARTMENT
RECEIVING AGENCY PROGRAM: BUREAU OF HIV AND STD PREVENTION
TERM: September 1, 1995 THROUGH November 30, 1995
SECTION I. SCOPE OF WORK:
PERFORMING AGENCY will initiate and implement early intervention services
for Texas residents who have tested positive for human immunodeficiency virus
(HIV), the virus that causes acquired immunodeficiency syndrome (AIDS),
and/or implement programs for technical assistance to early intervention
providers. Early intervention services are intended to postpone the onset of
AIDS. The goal of early intervention is for the HIV-positive individual to
voluntarily enter into a medical care and psychcsocial support system that
will, over the long term, maximize disease management, healthy behavior,
and quality of life.
If PERFORMING AGENCY provides residential care, it must have a current Special
Care Facility license on file, or be in the process of applying for a Special
Care Facility license, or have an exemption from the Texas Care Facility
Licensing Act. This also applies to any licenses/permits required for the
performance of any other activities/services under this Attachment. Required
licenses and/or permits shall be maintained on a current basis during the
life of this Attachment.
All information and educational materials developed and provided by
PERFORMING AGENCY will be accurate, comprehensive, and consistent with current
findings of the United States Public Health Service.
PERFORMING AGENCY agrees that all activities will be performed in accordance
with RECEIVING AGENCY's request for proposal (RFP) and assurances and PER-
FORMING AGENCY's application and detailed budget as approved by RECEIVING
AGENCY. All of the above-named documents are adopted by reference as part
of this Attachment. All revisions to said documents will be approved by
RECEIVING AGENCY and transmitted in writing to PERFORMING AGENCY.
PERFORMING AGENCY agrees to comply with the following:
Chapters 81 and 85, Health and Safety Code.
PERFORMING AGENCY will provide an estimated 50 clients with
services/units of service in or benefiting the county(ies)/area defined as:
LUBBOCK.
SECTION II. LEGAL AUTHORITY TO CONTRACT:
Chapters 12 and 121, Health and Safety Code.
SECTION III. SPECIAL PROVISIONS:
RECEIVING AGENCY will supply PERFORMING AGENCY with the most current version
of the document entitled "Content of AIDS -Related Written Materials,
Pictorials, Audiovisuals, Questionnaires, Survey Instruments, and Educational
Sessions in Centers for Disease Control Assistance Program," and its preface
which is written by RECEIVING AGENCY. PERFORMING AGENCY has provided
RECEIVING AGENCY with written acknowledgement of receipt and assurance of
compliance with these guidelines. All of the above referenced documents are
incorporated as part of this Attachment as though written herein verbatim.
General Provisions, CONFIDENTIALITY Article, is amended to include the
following paragraphs:
Due to the sensitive and highly personal nature of HIV/AIDS-related
information, strict adherence to the General Provisions Confidentiality
Article is required. Confidentiality of all records is essential.
PERFORMING AGENCY's success depends upon whether persons at risk believe
that the program observes this principle.
The Texas Health and Safety Code (81.103) provides for both civil and
criminal penalties against anyone who violates the confidentiality of
persons protected under the law. PERFORMING AGENCY will require all
employees, volunteers, subcontractors, and subcontractors' employees to
sign a statement of confidentiality assuring compliance with the law.
These statements must be available for inspection by RECEIVING AGENCY
Program staff at the PERFORMING AGENCY headquarters and at each
respective subcontractor office.
In addition to these conditions, if performing counseling, testing,
referral and partner notification activities, PERFORMING AGENCY will com-
ply with RECEIVING AGENCY's Bureau of HIV and STD Control's HIV Serologic
Testing and Documentation Guidelines; TDH Pretest and Posttest Counsel-
ing Guidelines; TDH Seropositive and Partner Notification Guidelines; and
CTRPN Quality Assurance Guidelines.
All of the above -referenced documents are incorporated as part of this
Attachment as though written herein verbatim.
General Provisions, PROGRAM INCOME Article, is amended to include the
following paragraphs:
Persons who are indigent (200% of federal poverty level or less) may not
be charged for any services covered by this Attachment. All other
clients may be charged a sliding scale fee based on income, or the
client may be charged co -payments if insurance is to be collected. A
sliding fee for co -payments, including waiver of co -payments, is also
recommended because these payments can be burdensome to low income
individuals, or to families with more than one HIV -affected member.

PERFORMING AGENCY, or any subcontractor, shall not transfer a client record
(including a patient record) to another entity or person without written
consent from the client or patient, or someone authorized to act on his or her
behalf; however, the RECEIVING AGENCY (TEXAS DEPARTMENT OF HEALTH) may require
PERFORMING AGENCY, or any subcontractor, to transfer a client or patient
record to the RECEIVING AGENCY (TEXAS DEPARTMENT OF HEALTH) if the transfer
is necessary to protect either the confidentiality of the record or the health
and welfare of the client or patient.
The RECEIVING AGENCY (TEXAS DEPARTMENT OF HEALTH) shall have access to a
client record (including a patient record) in the possession of PERFORMING
AGENCY, or any subcontractor, under authority of the Health and Safety Code,
Chapters 81 and 85, and the Texas Revised Civil Statutes, Article 4495b
(Medical Practice Act). In such cases, the RECEIVING AGENCY (TEXAS DEPARTMENT
OF HEALTH) shall keep confidential any information obtained from the client
or patient record, as required by the Health and Safety Code, Chapter 81, and
the Texas Revised Civil Statutes, Article 4495b.
PERFORMING AGENCY will submit quarterly activity reports within twenty (20)
days after the end of each quarter, that are prepared in the format provided
by RECEIVING AGENCY.
PERFORMING AGENCY will authorize their staff to attend training, conferences,
and meetings for which funds were budgeted and approved by RECEIVING AGENCY.
