RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to
execute for and on behalf of the City of Lubbock a South Plains Auto Theft Prevention Task
Force Agreement, between the Lubbock County Criminal District Attorney's Office and the
Lubbock Police Department, attached hereto, which shall be spread upon the minutes of the
Council and as spread upon the minutes of this Council shall constitute and be a part of this
Resolution as if fully copied herein in detail.

SOUTH PLAINS AUTO THEFT PREVENTION
TASK FORCE AGREEMENT
THIS AGREEMENT is entered into on this 28th day of September ,
1995, BETWEEN THE LUBBOCK COUNTY CRIMINAL DISTRICT ATTORNEY'S
OFFICE (hereinafter referred to as "CDA") AND THE LUBBOCK POLICE
DEPARTMENT (hereinafter referred to as "LPD").
WHEREAS there is evidence that motor vehicle theft and theft of
related motor vehicle equipment exists in the Lubbock, Texas area and
that such illegal activity has a substantial and detrimental effect on the
safety and general welfare of the citizens of Lubbock, Texas, the parties
hereto agree to the following:
1. The South Plains Auto Theft Prevention Task Force will perform the
following activities and duties described below:
A. Disrupt the theft of motor vehicles in the Lubbock, Texas area
by immobilizing targeted violators and/or their organizations;
B. Gather and report intelligence data related to motor vehicle
theft and theft of motor vehicle equipment to participating
agencies.
C. Conduct appropriate investigations in order that the task
force's activities will result in effective prosecution before the
courts of Lubbock County and the State of Texas.

2. To accomplish the objectives of the South Plains Auto Theft Prevention
Task Force, the LPD agrees to detail (1) experienced officer to said
task force for a period of not less than one year. During this period of
assignment, the one (1) officer will be under the direct supervision and
control of task force supervisory personnel.
3. The LPD officer assigned to the task force shall continue to adhere to
the policies and procedures of the Lubbock Police Department as
well as the any policies and procedures developed by the task force.
Should a conflict between agency policies develop, then the more
restrictive policy or procedure shall be followed. Failure to adhere to
any and all policies and procedures shall be grounds for removal from
the task force.
4. The LPD shall furnish the LPD officer assigned to the task force with a
vehicle and radio. The LPD will be expected to assume all vehicle -
related expenses. When investigative duties carry the LPD officer
beyond the jurisdictional boundaries of the LPD, the vehicle -related
expenses shall remain the responsibility of the LPD. The LPD officer
assigned to the task force shall adhere to policies of the LPD on
personnel use and home storage of his assigned vehicle.

5. To accomplish the objectives of the South Plains Auto Theft Prevention
Task Force, the CDA shall provide, through a State Funded Grant, one
(1) attorney, one (1) administrator and (5) investigative officers, as well
as one (1) clerical support person. The CDA will also, subject to the
availability of appropriated funds, provide necessary funds and
equipment to support the activities of the task force. This support will
include: office space, office supplies, investigative equipment,
training, and the reimbursement to the City of Lubbock for the salary,
overtime, and fringe benefits of the LPD officer assigned to the task
force. This reimbursement shall be invoiced quarterly. (See Exhibit A)
6. Assets or property lawfully seized through the South Plains Auto Theft
Prevention Task Force, shall after applicable forfeiture proceedings,
be forfeited to the South Plains Auto Theft Prevention Task Force.
7. The LPD shall permit and have readily available for examination and
auditing by the CDA or his authorized agent, any and all records,
invoices, and reports relating to this agreement. The LPD shall
maintain all such reports and records until all audits and examinations
are completed and resolved, or for a period of three (3) years after
the termination of this agreement, whichever is sooner.

8. The term of this agreement shall be from the date of signature by
representatives of both parties. This agreement may be terminated by
either party on thirty (30) days advance written notice. All billing for
outstanding obligations must be received by CDA within 90 days of
the date of termination of this agreement.
