AN ORDINANCE AMENDING CHAPTER 24, "VEHICLES FOR HIRE", OF
THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY
REVISING SECTION 24.02.111 AND SECTION 24.03.111 IN REGARDS TO THE
MINIMUM INSURANCE REQUIREMENTS FOR TRANSPORTATION -FOR -
HIRE SERVICE COMPANIES AND TRANSPORTATION NETWORK
COMPANIES; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE;
AND PROVIDING FOR PUBLICATION.
WHEREAS, Section 215.004(a)(1) of the Texas Local Government Code requires a
municipality to regulate private passenger vehicles that provide taxicab transportation
services for compensation, and Sections 215.004(a)(2) -(d), 215.029, 215.073, and
215.0735 of the Texas Local Government Code permit a municipality to regulate drivers
and vehicles engaged in the carrying of passengers for compensation; and
WHEREAS, the City Council of the City of Lubbock, Texas, in order to provide for the
equitable application of vehicle for hire insurance regulation, deems it in the best interest
of the health, safety, and welfare of the citizens of Lubbock to amend the Code of
Ordinances in regards to the minimum insurance requirements for transportation -for -hire
service companies and transportation network companies, NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 24.02.111 of the Code of Ordinances, City of Lubbock,
Texas, is hereby amended to read as follows:
"Sec. 24.02.111 Minimum insurance limits
The liability coverage for transportation -for -hire vehicles must meet the minimum
insurance coverage standards required by the City of Lubbock."
SECTION 2. THAT Section 24.03.111 of the Code of Ordinances, City of Lubbock,
Texas, is hereby amended to read as follows:
"Sec. 24.03.111 Minimum insurance limits
The liability coverage for transportation network company vehicles must meet the
minimum insurance coverage standards required by the City of Lubbock."
SECTION 3. THAT, unless otherwise provided herein, a violation of any provision of
this Ordinance shall be deemed a misdemeanor punishable as provided by Section
1.01.004 of the Code of Ordinances of the City of Lubbock.
SECTION 4. THAT should any paragraph, section, clause, phrase or word of this
Ordinance be declared unconstitutional or invalid for any reason, the remainder of the
Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary of the City of Lubbock, Texas. is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance
as an alternative means of publication provided by law.
