AN ORDINANCE ABANDONING AND CLOSING AN LP&L AERIAL
EASEMENT AND A PORTION OF A DRAINAGE AND STORMWATER
EASEMENT LOCATED IN LOT 306B MIDWAY PARK LUBBOCK COUNTY,
TEXAS,WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS
ORDINANCE;DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL
MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING;
PROVIDING A SAVINGS CLAUSE;AND PROVIDING FOR PUBLICATION.
WHEREAS,the City Council finds that the easements hereinafter described in the
body of this Ordinance are no longer needed for easement purposes and for public use;
and it would be in the public interest to close,vacate and abandon the same for easement
purposes and for public use;NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1.THAT the easements as hereinafter described shall BE and the
same are hereby closed,vacated and abandoned for easement purposes and for public
use,such easements being more particularly described in Exhibit "A"&"B".
SECTION 2.THAT the City Engineer is hereby authorized and directed to mark
the official maps of the City of Lubbock to reflect said abandonment and closing,
showing the number of this Ordinance and the date of its final passage.
SECTION 3.THAT should any section,paragraph,sentence,phrase,clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance as
an alternative method provided by law.
AND IT IS SO ORDERED.

Passed by the City Council on second reading this 15th day of December 2016 .

METES AND BOUNDS DESCRIPTION of a 0.4077 acre portion of a Drainage and Storm Water Easement, as described in
Volume 1261, Page 609, of the Deed Records of Lubbock County, Texas (DRLCT), being further described as follows:
BEGINNING at a fence post found in the North line of a 15 foot alley as described in Volume 490, Page 99, DRLCT, the South
line of said drainage and storm water easement, at the most Easterly Southeast corner of Lot 306-B, Midway Park Addition to
the City of Lubbock, Lubbock County, Texas, according to the map, plat and/or dedication deed thereof recorded in Volume
4439, Page 307 of the Real Property Records of Lubbock County, Texas (RPRLCT), the same being the Southeast corner of
this tract;
THENCE S. 55°43'41" W., along the Southern boundary of said Lot 306-B, the Southern boundary of said drainage and storm
water easement and the North line of said 15 foot alley, a distance of 20.19 feet to a 60 penny nail set for the Southwest corner
of said drainage and storm water easement;
THENCE N. 34°14'08" W., along the West line of said drainage and storm water easement, a distance of 201.04 feet to an "x"
cut in concrete set in the South line of a 30 foot drainage and storm water easement as granted by plat recorded in Volume
1261, Page 616, DRLCT;
THENCE S. 78°34'32" W, along the Southern boundary of said 30 foot drainage and storm water easement, a distance of
336.46 feet to a 60 penny nail set in the West line of a 20 foot underground utility easement as dedicated by plat recorded in
Volume 4439, Page 307 RPRLCT, for a corner of this tract;
THENCE N. 09°01'40" W., along the West line of said 20 foot underground utility easement, a distance of 30.03 feet to a 60
penny nail set in the North line of said 30 foot drainage easement, for a corner of this tract;
THENCE N. 78°34'32" E., along the North line of said 30 foot drainage and storm water easement a distance of 322.58 feet to
an "x" cut in concrete set in the West line of said drainage and storm water easement;
THENCE N. 34°14'08" W, along the West line of said drainage and storm water easement, a distance of 156.42 feet to a 60
penny nail set for the Northwest corner of said Drainage and Storm Water Easement and a corner of this tract;
THENCE N. 55°43'41" E., along the North line of said drainage and storm water easement, a distance of 20.19 feet to a 60
penny nail set in the Eastern boundary of said Lot 306-B for the Northeast corner of this tract;
THENCE S. 34°14'08" E., along the Eastern boundary of said Lot 306-B, a distance of 390.00 feet to the Point of Beginning.
