AN ORDINANCE DESIGNATING A REINVESTMENT ZONE WITHIN THE
CITY OF LUBBOCK AS AUTHORIZED BY CHAPTER 312 OF THE TEXAS TAX
CODE; DESCRIBING THE BOUNDARIES OF SAID ZONE; DESCRIBING THE
ELIGIBILITY OF SAID ZONE FOR COMMERCIAL -INDUSTRIAL TAX
ABATEMENT; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR
PUBLICATION.
WHEREAS, Chapter 312 of the Texas Tax Code authorizes the City Council of the City
of Lubbock to designate a Reinvestment Zone for commercial -industrial tax abatement
purposes; and
WHEREAS, the City of Lubbock has established its intent to participate in tax abatement
by Resolution and has established guidelines and criteria for commercial -industrial tax
abatement within the City of Lubbock; and
WHEREAS, the City Council of the City of Lubbock declared its intent to create a
Reinvestment Zone by its adoption of Resolution No. 2016-RO341 on September 22, 2016,
authorizing the City Secretary to send a Notice of Intent to all taxing units levying taxes
on the real property located within the zone; and
WHEREAS, the boundaries of the Reinvestment Zone were described in the Notice of
Intent attached to and made a part of Resolution No. 2016-R0341; and
WHEREAS, the City Council held a public hearing to consider the establishment of said
Reinvestment Zone which was conducted on October 13, 2016, prior to the adoption of
this Ordinance; and
WHEREAS, the City Council found, at the conclusion of said hearing, that the
improvements sought for the property within the Reinvestment Zone are feasible, practical.
and would benefit the land; and
WHEREAS, the City Council of the City of Lubbock has determined and finds that the
real property to be included in the Reinvestment Zone will be reasonably likely as a result
of the designation to contribute to the retention or expansion of primary employment and
would contribute to the economic development of the City of Lubbock; and NOW
THEREFORE;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1: THAT by and under the authority of Chapter 312 of the Texas Tax Code.
the following described real property located within the City of Lubbock, County of
Lubbock, Texas, is hereby designated as a Reinvestment Zone:
THAT 150.00 ACRE TRACT OF LAND LOCATED IN SECTION 39, BLOCK D, L&SV
RAILROAD COMPANY SURVEY, ABSTRACT 6, LUBBOCK COUNTY, TEXAS,
BEING THE EAST 150b0 ACRES OF THAT SAME LAND DESCRIBED AS TRACT 1 IN
A DEED RECORDED WITH THE COUNTY CLERK AS FILE NUMBER 2007048830,
OFFICIAL PROPERTY RECORDS OF LUBBOCK COUNTY, TEXAS,
A description and depiction of the area designated as the Reinvestment Zone is attached
hereto and is incorporated in this Ordinance as Exhibit 1.
SECTION 2. THAT the area of the Reinvestment Zone will be reasonably likely as a
result of the designation to contribute to the retention or expansion of primary employment
and will contribute to the economic development of the City of Lubbock.
SECTION 3. THAT should any paragraph, section, sentence, phrase, clause, or word of
this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and
directed to cause publication of the descriptive caption of this Ordinance as an alternative
method provided by law.

Monsanto Property Description
METES AND BOUNDS DESCRIPTION of a 150.00 -acre tract of land located in
Section 39, Block D, L&SV Railroad Company Survey, Abstract 6, Lubbock County.
Texas, being the East
150.00 acres of that same land described as Tract 1 in deed recorded in County Clerk File
Number 2007048830, Official Property Records of Lubbock County, Texas, being further
described as follows:
BEGINNING at a 1112" iron rod and cap marked "HUGO REED ASSOC" set in the North
line of said Section 39 for the Northwest corner of this tract, which bears S. 88°28'45" E.
a distance of 1644.47 feet from a 112" iron rod found at the Northwest corner of said Section
39;
THENCE S. 88028'45" E., along the North line of said Section 39, a distance of 2441.55
feet to a railroad spike found in the West right-of-way line of Interstate Highway 27 at the
Northeast comer of this tract;
THENCE S. 01 022'14" E., along the West right-of-way line of said 1-27, at 50.14 feet pass
a 112" iron rod with cap marked "STEVENS RPLS 4339" found in reference, continuing
for a total distance of 998.02 feet to a 112" iron rod with cap marked "HUGO REED
ASSOC" set for a corner of this tract;
THENCE S. 02047'29" W., continuing along said right-of-way line a distance of 651.95
feet to a 11211 iron rod with cap marked "HUGO REED ASSOC" set for a comer of this
tract;
THENCE Southeasterly, continuing along said right-of-way line, along a curve to the left,
said curve having a radius of 3994.83 feet, a central angle of 13°30'18", a chord bearing of
S. 03°57'38" E., a chord distance of 939.44 feet to a 1!2" iron rod with cap marked
"STEVENS RPLS 4339" found at a corner of this tract;
THENCE S.10043'1411 E.. continuing along said right-of-way line a distance of 47.32
feet to a 112" iron rod with cap marked "RL SMITH RPLS 3906" found in the South line
of the North half of said Section 39 at the Southeast corner of this tract;
THENCE N. 88"36'34" W., along the South line of said North Half, a distance of 2568.08
feet to a 112" iron rod with cap marked "HUGO REED & ASSOC" set for the Southwest
corner of this tract;
THENCE N. 0119'20" E. a distance of 2635.78 feet to the Point of Beginning.
