HomeMy WebLinkAboutResolution - 5161 - Interlocal Agreement - TAES - 80 Acres Of Land - 04/11/1996Resolution No.5161 April 11, 1996 Item #18 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Agreement, attached herewith, by and between the City of Lubbock and the Texas Agricultural Experiment Station, and any associated documents, which Agreement shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Vandiver, First Assistant City Attorney ddresfa&magr. res ccdocs/a&magr. res March 26, 1996 Resolution No.5161 April 11, 1996 Item #18 INTERLOCAL AGREEMENT THE STATE OF TEXAS § COUNTY OF LUBBOCK § This Agreement is made and entered into by and between the Texas Agricultural Experiment Station (hereinafter called "Station"), and the City of Lubbock, a home rule municipal corporation of the State of Texas (hereinafter called "City") pursuant to Chapter 791, Government Code (Interlocal Contracting Act). WHEREAS, THE TEXAS AGRICULTURAL EXFERMMNT STATION located in Lubbock County desires to obtain the right to utilize approximately 80 acres of land owned by the CITY OF LUBBOCK for purposes of agricultural experimentation; and WHEREAS, the City desires to cooperate with the Station in said project; NOW THEREFORE: WITNESSETH: The parties hereto have agreed as follows: 1) LAND. The Station desires to utilize approximately 30 acres of land for corn and sorghum research plots, and approximately 50 acres of land for cotton research plots as further described on the map attached hereto as Exhibit A. 2) TERM. This Agreement shall be for a term of one (1) year from the date of execution hereof by the parties. It may be renewed annually for additional one (1) year terms by mutual agreement of the parties hereto expressed in writing prior to the end of any prior term. 3) RESEARCH PROJECTS: A) CORN. 1) Approximately 26 acres of corn will be utilized in a study in which Banks grass mites will be released on very small portions of the total acreage. Various beneficial insects will be released in most of the plots to determine their ability to control the Banks grass mites. 2) Approximately 2 acres of corn will be utilized in a weed control study. Various herbicides will be applied to determine the most effective and efficient herbicides for weed control in corn production. B) GRAIN SORGHUM. Approximately 2 acres of sorghum will be utilized in a weed control study. Various herbicides will be applied to determine the most effective and efficient herbicides for weed control in corn production. C) COTTON. Approximately 30 acres of cotton will be planted for various performance tests. These will include tests of varieties, hybrids, new strains, glandless strains and other tests as deemed necessary. The remaining 20 acres will be planted for production to be given to the City of Lubbock as part of the consideration for entering this agreement. 4) FARMING OPERATIONS. The Station will arrange for the supply of all herbicides, fertilizer, seed, insecticides and harvest aids that are required for use on research projects. The Station agrees to follow all applicable environmental and safety regulations with regard to the use of herbicides and pesticides. Equipment needs will be arranged by consultation with the City's representatives, John Hindman and Mr. Brad Welch. All other farming operations will be managed to the benefit of all parties involved. S) CONSIDERATION. It is expected that less than 1 per cent of the corn and sorghum will be harvested for Station needs. The remainder will be left to the City for cattle grazing or other uses. It is expected that approximately 40 per cent of the cotton will not be used by the Station and will be left to the City for its use. The total value of the consideration for this agreement will be dependent upon the yield per acre achieved. Any payments required to be made pursuant to this Agreement shall be made from current revenues available to the paying party in accordance with Sec. 791.011, Government Code. 6) INDEMNITY. The Station and the City each agree to be solely responsible for any negligence, liability, claims or damages of any nature whatsoever arising from the activities of its own officers, employees and agents with regard to this joint project to the extent permitted by law. 7) APPLICABLE LAW, This Agreement is made by and subject to the laws of the State of Texas.
