HomeMy WebLinkAboutResolution - 5157 - Professional Services Contract-Lewis Mcbride-Executive Director, RRP - 04/11/1996Resolution No. 5157 1 April 11, 1996 Item #10 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Personal Services Contract with Lewis "Eddie" McBride for the services as Executive Director for the Reese Redevelopment Project until the local redevelopment authority is formed. Said Contract is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Chamales, Assistant City Attorney LLC Js/PSC-LEM.RES ccdocs/April 2, 1996 RESOLUTION NO. 5157 April 11, 1996 Item X110 PERSONAL SERVICES CONTRACT STATE OF TEXAS § COUNTY OF LUBBOCK § This Contract and Agreement, made and entered into on this the 11 th day of April , 1996, by and between the CITY OF LUBBOCK, TEXAS, a Home Rule Municipal Corporation of the State of Texas, hereinafter called "City," and LEWIS f4EDDIE" McBRIDE, hereinafter called "Director". WHEREAS, the City has determined that it will, on a temporary basis, require the services of an Executive Director for the Reese Redevelopment Project until the local redevelopment authority is formed; and WHEREAS, the City has determined that it will be in the best interest of the City to retain the services of Eddie McBride to assist it in furnishing the services of executive director as required; and WHEREAS, the above individual has agreed to furnish the services pending the formation of a local redevelopment authority, at which time this agreement will be assigned to the local redevelopment authority; NOW THEREFORE, the parties hereto do covenant and agree as follows: h Under the terms and conditions set forth herein, the City does hereby engage and retain Lewis "Eddie" McBride to provide the following general services as Executive Director for the Reese Redevelopment Project: initiate, develop and coordinate planning activities under broad administrative direction of the Lubbock/Reese Redevelopment Authority for adaptive reuse of Reese Air Force Base following its closure; coordinate the activities of various committees, subcommittees, task forces, and community groups involved in the redevelopment effort, and perform related duties as required. II. The parties agree to the following terms and conditions: (a) This agreement is contingent on approval of Director's contractual employment and resume by the Office of Economic Adjustment; and. (b) The term of this contract shall be for a period of one year beginning on April 22, 1996; further renewals and extensions will be subject to grant approvals by the Office of Economic Adjustment; and (c) This contract and agreement may be assigned to the local redevelopment authority when formed; and (d) Either party hereto may terminate this agreement at any time during the term of this agreement by giving thirty (30) days notice of intention to terminate this contract. City agrees to pay Director as compensation for services rendered hereunder an annual base pay $60,000.00 plus mileage reimbursement for work-related travel at the prevailing IRS rate, which is currently thirty-one cents ($ 0.31) per mile. LU11 City agrees to pay the following benefits to Director: (a) Medical insurance in the approximate amount of $ 2,375.00/yr. for Director, with dependent coverage being at Director's cost; and (b) Dental insurance in the approximate amount of $190.00/yr. for Director, with dependent coverage being at Director's cost; and (c) Ten thousand dollars in life insurance at the approximate rate of $32.50/yr. for Director, with dependent coverage being at Director's cost; and (d) Long term disability insurance at the approximate rate of $190.00/year for Director; and (e) Director shall be entitled to 15 days of paid sick leave; and (f) Director shall be entitled to nine (9) paid holidays annually, and may accrue two weeks of paid vacation annually; and (g) Director shall be entitled to five (5) paid personal leave days to move family and attend retirement ceremony; and (h) Director shall not be eligible for the City's retirement plan. Director agrees to provide the following services as his principal duties and responsibilities: (a) Advise and support committees and task forces involved in base redevelopment planning; and (b) Supervise the work of support staff engaged in conducting research and analysis; preparing a base reuse plan; and preparing related reports, position papers, and correspondence; and (c) Prepare and deliver presentations on behalf of committees and task forces as necessary; and (d) Act as liaison between the committees and participating local, state, and federal agencies, including the Office of Economic Adjustment and the Department of Defense; and (e) Coordinate preparation of a comprehensive redevelopment plan for review and adoption by the local redevelopment authority and City Council; and (f) Monitor the work performed by any subcontractors hired for the project; and (g) Inform the public of the reuse planning process and related issues; and (h) Prepare and submit quarterly reports on activities and progress toward meeting goals; and (i) Supervise the preparation, posting and distribution of meeting notices and agendas as well as supervising the recording and transcription of meeting minutes; and (j) Prepare appropriate grant applications, monitor grant performance and submit grant progress reports for base redevelopment activities. VI. Nothing contained herein shall be construed as creating the relationship of employer and employee between the City and Director. Director shall be deemed at all times to be an independent contractor for tax purposes. PERSONAL SERVICES CONTRACT LEWIS "EDDIE" McBRIDE ---- PAGE 3 Director shall at all times observe and comply with all Federal, State and local laws, ordinances and regulations, which in any manner affect the agreement and shall indemnify and save harmless the City against any claim arising from the violation of any such law, ordinances and regulations by Director.
