HomeMy WebLinkAboutResolution - 4819 - Interlocal Animal Control Services Agreements - Various Political Subdivisions - 04/27/1995Resolution No. 4819 April 27, 1995 Item 929 [:._.i3 11_ BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Manager or his designated representative is hereby authorized and directed to execute for and on behalf of the City of Lubbock all Interlocal Animal Control Services Agreements in substantially the same form as the attached Agreements with various political subdivisions desiring to utilize City of Lubbock animal control services. Copies of such form Interlocal Animal Control Services Agreements are attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. March 30, 1995 Resolution No. 4819 April 27, 1995 Item #29 INTERLOCAL AGREEMENT STATE OF TEXAS § ANIMAL CONTROL SERVICES COUNTY OF LUBBOCK § WHEREAS, a need exists for animal control services in -Buffalo Spring s , a political subdivision outside the city limits o the City of Lubbock; and WHEREAS, the City of Lubbock agrees to furnish such services; NOW THEREFORE: WITNESSETH: This Interlocal Agreement is entered into this day of 19 , by and between Buffalo Springs and the City of Lubbock for the mutual covenants hereinafter set forth and both Cities hereby agree as follows: 1. The City of Lubbock agrees to receive and destroy all animals delivered for disposal to the premises hereinafter set forth, by any duly authorized officer or employee of Buffalo Springs , if said animals are accompanied by an affidavit of ownership signed by the authorized government official of Buffalo Springs ^ 2. Buffalo Sp r i ngs agrees to deliver the animals with an affidavit of ownership signed by the authorized government official of Buffalo Springs to the Lubbock Animal Shelter at 401 North Ash, Lubbock, Texas, or such other location as may be speaied by the City of Lubbock, on any weekday morning prior to the City of Lubbock Animal Shelter's scheduled elimination of animals. 3. In consideration of the above-mentioned covenants with the City of Lubbock, Buffalo S Rr i n g 5 agrees to pay to the City of Lubbock the surn of S10.00 per disposed animal. shall make payments at the time of delivery to the City of Lubbock. 4. AU fees to be paid hereunder shall be paid from current revenues of the party receiving the services. 5. The Animal Control Department of the City of Lubbock Health Department also will agree to kennel animals left at the Animal Shelter. However, for each animal boarded, there will be a charge of s5_nn per day. 6. The term of this Agreement shall be one (1) year from the date of execution of this Agreement. This Agreement may be renewed for successive one (1) year terms under the same terms and conditions, except for rate change, by mutual agreement of the parties expressed in writing at least thirty (30) days prior to the end of each one (1) year term. 7. Either party may decide to terminate this Agreement for any reason. However the terminating party must supply the other party with a written notice thirty (30) days before termination. Buffalo Springs agrees to indemnify and saveham-Jess the City of Lubbock from and against all claims, suits, damages, costs, losses, and expenses in any manner resulting from, arising out of, or connected with performance of this Agreement, All claims and complaints shall be directed to Buffalo Springs and the City of Lubbock shall be in no manner liable for performance in connection with this Agreement. SERVICES COUNTY OF LUBBOCK WHEREAS, a need exists for animal control services in New Dea 1 , a political subdivision outside the city limits of the City of Lubbock; and WHEREAS, the City of Lubbock agrees to furnish such services; NOW THEREFORE: WITNESSETH: This Interlocal Agreement is entered into this 27th day of February 19 9 5:P by and between New Deal and the City of Lubbock for the mutual covenants hereinafter set forth and both Cities hereby agree as follows: 1. The City of Lubbock agrees to receive and destroy all animmals delivered for disposal to the premises hereinafter set forth, by any duly authorized officer or employee of New Dea 1, if said animals are accompanied by an affidavit of ownership signed by the authorized government official of New Dea 1 2. In consideration of the above-mentioned covenants with the City of Lubbock, Petersburg agrees to pay to the City of Lubbock the sum of S i o . oc per disposed animal. Petersburq shall make payments at the time of delivery to the City of Lubbock. 4. All fees to be paid hereunder shall be paid from current revenues of the party receiving the services. 5. The Animal Control Department of the City of Lubbock Health Department also will agree to kennel animals left at the Anjr-nA Shelter.
