AN ORDINANCE: ANNEXING INTO THE CITY OF LUBBOCK, TEXAS

APPROXIMATELY SEVENTY-TWO (72) ACRES, ADJACENT TO THE WESTERN

CITY LIMITS OF THE CITY OF LUBBOCK, NORTH OF 50TH STREET AND
EAST OF ALCOVE AVENUE, LUBBOCK COUNTY, TEXAS, WITH SUCH AREA

BEING CONTIGUOUS TO THE EXISTING CITY LIMITS; PROVIDING FOR THE
CORRECTION OF THE CITY MAP TO INCLUDE THE AREA ANNEXED
THROUGH THIS ORDINANCE; PROVIDING A SAVINGS CLAUSE; AND
PROVIDING FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock (the "City Council"), received from the
property owners (the "Petitioners") of an area of land contiguous to the city limits (the
"Area"), a written petition requesting the annexation of the Area into the boundaries of the
City of Lubbock; and
WHEREAS, in accordance with Sec. 43.0672 of the Texas Local Government Code, the
City Council entered into an Annexation Agreement (the "Agreement"), by and between the
City of Lubbock and the Petitioners at the City Council's regularly scheduled meeting on
August 11, 2020, with a copy of the Agreement being attached to and incorporated herein as
"Exhibit A"; and
WHEREAS, the City Council directed that the annexation of the Area contemplated in the
Agreement be effectuated through this Ordinance; and
WHEREAS, the City Council deems it to be in the best interest of the citizens of the City of
Lubbock to annex the Area into the City of Lubbock through this Ordinance;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Area is hereby annexed into, and included within, the corporate
limits of the City of Lubbock, Texas. Such Area is depicted and described in the attached
"Exhibit A," and is incorporated herein for all intents and purposes. Such Area is contiguous
to the existing corporate limits of the City of Lubbock, Texas.
SECTON 2. THAT the City Council hereby declares it to be its purpose to annex into the
City of Lubbock every part of the Area. Should this Ordinance for any reason be ineffective
as to any part or parts of the Area hereby annexed into the City of Lubbock for full purposes,
the ineffectiveness of this Ordinance as to any such part or parts shall not affect the
effectiveness of this Ordinance as to the remainder of the Area.
'TION 3. THAT the City Engineer, or his designee, is hereby authorized and directed to
-let the map of the City of Lubbock by adding thereto the Area annexed by this
nance, indicating on the map the date of annexation and the number of this Ordinance.
City Secretary and the City Engineer shall each keep in their respective offices an official
map of the City of Lubbock showing the boundaries of the municipal corporation, including
this annexation.
SECTION 4. THAT upon the effective date of this Ordinance, any current or future
inhabitant of the Area shall be entitled to the rights and privileges of other citizens of the City
of Lubbock, Texas and shall be bound by the acts and ordinances adopted by the City of
Lubbock, Texas.
SECTION 5. THAT should any paragraph, section, sentence, phrase, clause or word of this
Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 6. THAT the City Secretary is hereby authorized and directed to cause
publication of the descriptive caption of this Ordinance as an alternative method of
publication provided by law.
AND IT IS SO ORDERED.

A 72.015 acre tract of land located in the Southwest Quarter (SW/4) of Section 39, Block AK, G.C. & S.F.
RR. Co. Survey, Abstract Number 228, Lubbock County, Texas, and being that same certain tract of land
conveyed to FOUR EC, LLC, a Texas limited liability company, described as "Tract 2" in a Special
Warranty Deed recorded in County Clerk's File Number 2019026001 of the Official Public Records of
Lubbock County, Texas, said 72.015 acre tract being further described by metes and bounds as follows:
BEGINNING at a 1/2" iron rod found near the center of the intersection of Alcove Avenue and 501h Street
at the southwest corner of said Section 39 for the southwest corner of this tract and having coordinates of
Northing: 7,264,077.95 and Easting: 904,880.95 of the Texas Coordinate System of 1983 (2011), Texas
North Central Zone, whence a 1/2" iron rod with a cap marked "AMD ENG" set for a 55 foot by 55 foot
offset bears N.46° 51' 41" E. a distance of 77.79 feet;
THENCE N. 01 ° 51' 52" E., along the west line of said Section 39, a distance of 1367.74 feet to a 1/2" iron
rod with a cap marked "AMD ENG" set near the centerline of Alcove Avenue at the southwest corner of
that certain 2.0 acre tract of land described in Volume 4094, Page 322 of the Real Property Records of
Lubbock County, Texas, for a corner of this tract;
THENCE S. 880 08' 08" E., along the south line of said 2.0 acre tract and the south line of that certain 2.14
acre tract of land described in County Clerk's File Number 2013046409 of the Official Public Records of
Lubbock County, Texas, a distance of 407.53 feet to a 1" iron pipe found at the southeast corner of said 2.14
acre tract for an ell corner of this tract;
THENCE N. 01 ° 51' 52" E., along the east line of said 2.14 acre tract and the east line of that certain 3.86
acre tract of land described in County Clerk's File Number 2013046409 of the Official Public Records of
Lubbock County, Texas, a distance of 854.89 feet to a 1" iron pipe found at the northeast corner of said 3.86
acre tract for an ell corner of this tract;
THENCE N. 880 08' 08" W., along the north line of said 3.86 acre tract at a distance of 352.53 feet pass a
1/2" iron rod with a cap marked "AMD ENG" set in reference, continuing for a total distance of 407.53 feet
to a 1/2" iron pipe found in the west line of said Section 39 at the northwest corner of said 3.86 acre tract
for a corner of this tract;

THENCE S. 880 09' 53" E., at a distance of 55.00 feet pass a 1/2" iron rod with a cap marked "AMD ENG"
set in reference, continuing at a distance of 417.60 feet pass a 3/4" iron pipe found, continuing for a total
distance of 1320.00 feet to a 1" iron pipe found (bent, reset with this survey) at the northeast of this tract,

centerline of 50th Street and in the south line of said Section 39 for the southeast corner of this tract, whence
a railroad spike found at the southeast corner of said Section 39 bears S. 88' 08' 3 1 " E. a distance of 3963.87
feet, said section corner having coordinates of Northing: 7,263,906.67 and Easting: 910,160.81 of the Texas
Coordinate System of 1983 (2011), Texas North Central Zone;
THENCE N. 880 08' 3 1 " W. a distance of 1320.00 feet to the Point of Beginning. Bearings and coordinates
are relative to the Texas Coordinate System of 1983 (2011), Texas North Central Zone, as calculated from
an origin of Latitude: North 33' 33' 08.9177" and Longitude: West 101 ° 59' 14.4395" (NAD'83). Distances
are at surface, in U.S. survey feet.
