RESOLUTION
WHEREAS,under Section 113.051 of the Texas Natural Resources Code, the Legislature
has mandated that the Texas Railroad Commission "...promulgate and adopt rules or standards
or both relating to any and all aspects or phases of the Liquefied Petroleum Gas industry that will
protect or tend to protect the health, welfare, and safety of the general public;"and
WHEREAS,under Section 113.054 of the Texas Natural Resources Code, a political
subdivision may petition the Texas Railroad Commission executive director for permission to
promulgate more restrictive rules and standards to enhance public safety; and
WHEREAS,the City Council desires to enhance public safety with provisions not
included or contemplated in the Texas Railroad Commission Liquefied Petroleum Gas Safety
Rules in order to protect the health, welfare, and safety of the citizens of Lubbock,Texas.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT,City Council hereby directs City staff,including but not limited to the City
Attorney,Fire Marshal,and Fire Chief, to develop rules or regulations that will protect or tend to
protect the health,welfare,and safety of the general public regarding any and all aspects of
Liquefied Petroleum Gas currently not addressed by the Texas Railroad Commission Liquefied
Petroleum Gas Rules;and
THAT,City Council further directs City staff to seek a coalition of Texas cities with the
like intent of developing rules or regulations that will protect or tend to protect the health,
welfare,and safety of the general public regarding any and all aspects of Liquefied Petroleum
Gas currently not addressed by the Texas Railroad Commission Liquefied Petroleum Gas Rules;
and
THAT,City Council directs the City Attorney to petition the Texas Railroad Commission
executive director for permission to promulgate more restrictive rules and standards to enhance
public safety,as prescribed by Section 113.054 of the Texas Natural Resources Code.
