RESOLUTION
WHEREAS,the City of Lubbock,Texas,a Home Rule Municipality located in
Lubbock County,Texas,has determined and does hereby determine thatthe public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
landfor municipal public use and purposes,to-wit:forthe widening of Erskine Avenue
from Indiana Avenue to Quaker Avenue and the City Council of said City finds it in
the public interest and for public purposes and municipal purposes to proceed with the
acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1.THAT the fee simple title to the tract of land further described in
Exhibit "A" attached hereto, be acquired for public purposes and municipal purposes as
set forth in the preamble hereof.
SECTION 2.THAT the owner of said tract, being An undivided Vi interest:
The Estate of Gregoria Garcia,Deceased,An undivided Vi interest:Rita Garcia
Aguero,Joe Garcia,Jesse Garcia,and Cirilo Garcia,be offered through the Right-of-
Way Department of the City of Lubbock the amount of $12,990.00,which is the amount
appraised as the value.Plus closing cost for the fee simple title for the use and benefit of
the City of Lubbock,Texas,for the purposes herein stated, and unless accepted forthwith,
the City Attorney of said City of Lubbock is hereby authorized and instructed to institute
condemnation (eminent domain)proceedings to acquire the fee simple title.

BEGINNING at a "MAG" nail with shiner set in the South line of said Section 18 for the Southwest corner of a
1.0 acre tract as described under County Clerk File No. 2011043336 of the Official Public Records of Lubbock
County, Texas and the Southeast corner of this tract which bears N. 88°06'53" W. a distance of 1838.79 feet
from the Southeast corner of Section 18, Block A, Lubbock County, Texas;
THENCE N. 88006'53" W., along the South line of said Section 18, a distance of 88.39 feet to a "MAG" nail
with shiner set for the Southeast corner of a 0.4 acre tract as described in Volume 6486, Page 171 of the Rea]
Property Records of Lubbock County, Texas and the Southwest corner of this tract;
