RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed
to execute for and on behalf of the City of Lubbock a Change Order No 5, to Bid No.
97300 (D. E. Rice Construction Co., Inc.) with associated documents for and on behalf of
the City of Lubbock for the West Texas Region Disposal Facility Phase 1 Facility
Development. Said Agreement is attached hereto and incorporated in this Resolution as if
fully set forth herein and shall be included in the minutes of the Council.
Passed by the City Council this 19th day of November 1998.

RE: West Texas Region Disposal Facility — Phase I — Truck Scales.

It is our understanding that the submittals for the new truck scales have been approved as
of this date. We have authorized our subcontractor, Rusty's Weigh Scales and Service,
Inc., to begin fabricating / constructing one new set of scales. We anticipate the concrete
work required for the scales to begin within two weeks. •
As noted in my FAX to you on 9/28/98, it is our understanding that the City may want to
install two new sets of scales instead of just the one set as originally bid and contracted.
If this is the case, we need to know as soon as possible so that we can have the second set
of scales fabricated.
As discussed previously, we are willing to provide and install two, new truck scales, as
originally bid under Alternate D, for $87,824.00, even though this amount is $1,916.00
less than our actual cost of the scales from Rusty's Weigh (price to us for two new scales
is $89,740,00). Additional concrete, grating and I-beam installation is also required and
is not included in the cost from Rusty's Weigh.
We will await direction from you on this issue. Thank you.
