HomeMy WebLinkAboutResolution - 6142 - Exercise Option To Rescind Resolution 3259 - 12/16/1998Resolution No. 6142 Item No. 40 December 16, 1998 RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS, TO EXERCISE ITS OPTION TO RESCIND RESOLUTION NO. 3259 TO TAX PROPERTY OTHERWISE EXEMPTED FROM TAXATION UNDER SECTION 11.251 OF THE TAX CODE AND ARTICLE 8, SEC. 1 j, TEXAS CONSTITION. WHEREAS, Article 8, Sec. 1J, Subsection (a), of the Texas Constitution and Section 11.25 of the Tax Code permitted the City of Lubbock to choose to tax certain tangible property referred to as "freeport goods" that would otherwise have been tax exempt; and WHEREAS, the City Council of the City of Lubbock enacted Resolution No. 3259 on December 7, 1989, making such "freeport goods" subject to taxation; and WHEREAS, the City Council of the City of Lubbock now desires to rescind said Resolution No. 3259 as permitted by Article 8, Sec. 1-j, Subsection (b) of the Constitition so as to permit such "freeport goods" to be tax exempt; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT Resolution No. 3259 enacted on December 7, 1989, is hereby rescinded and shall be of no further effect and that tangible personal property described in Article 8, Sec. 1J, Subsection (a), of the Texas Constitution and Section 11.251 of the Tax Code as "freeport goods" shall hereafter be exempted from taxation.
