HomeMy WebLinkAboutResolution - 6082 - Amendment To Interlocal Agreement - Lubbock County - Library Services - 10/22/1998Resolution No. 6082 Item No. 47 October 22, 1998 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Amendment to an Interlocal Agreement by and between the City of Lubbock and the County of Lubbock for Library Services, and all related documents. Said Amendment is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Passed by the City Council this22n— day of October , 1998. - 4 M APPROVED AS TO CONTENT: 0yern Tommy Gotlzalez, Mrecto of Civic Services AS TO FORM: y ALSAWAmend Library County .RES.doc ccdocs/August 5, 1998 Resolution No. 6082 Item No. 47 October 22, 1998 STATE OF TEXAS § COUNTY OF LUBBOCK § AMENDMENT TO LIBRARY SERVICES CONTRACT This Agreement is entered into this 22nd day of October -.31 1998 between the City of Lubbock, a Texas municipal corporation (hereinafter called "the City") and Lubbock County, Texas, a political subdivision of the State of Texas (hereinafter called "the County"). WHEREAS, the County and the City have previously entered into a Joint Library Services Contract dated January 12, 1989 (hereinafter called "the Contract"); WHEREAS, the City and the County have collaborated with other governmental entities and officials to develop specific methods to attain the goal of Lubbock having the lowest published crime rate among cities of 100,000 or more in the State of Texas; WHEREAS, the County and the City have executed a Resolution affirming the commitment of both to the document known as Achieving the Goal; WHEREAS, it is the intent of the City and the County to amend the Library Services Contract to reduce the County's contribution to the City for those services; NOW THEREFORE, in consideration of the recitals stated above, the County and the City hereby agree to amend the Contract as follows: 1. Term of Contract is amended as follows: This Contract shall be effective from October 1, 1998 through September 30, 2000, and shall be automatically renewed each October 1$` thereafter, on written request of the City to continue the Joint Library Services Agreement. 2. Fund Allocation is amended as follows: The County will provide the total sum of Three Hundred and Twenty Thousand dollars ($320,000.00) for the period October 1, 1998 through September 30, 1999. The County shall allocate Two Hundred Fifty Thousand and no/100 dollars ($250,000.00) to the program entitled Achieving the Goal. Beginning on October 1, 1999, and continuing each year thereafter that this Agreement shall remain in effect, the County will provide the total sum of Seventy Thousand and no/100 dollars ($70,000.00) annually to City for the provision of Library Services. The County shall allocate Five Hundred Thousand and no/100 ($500,000.00) annually to the program entitled Achieving the Goal. 3. Paragraph entitled Revenues is hereby added to the Agreement as follows: Any payments made pursuant to the terms of this Agreement shall be made from the current revenues available to the paying party. For library funds appropriated after October 1, 2000, the parties agree that the amount of monetary support for library services provided pursuant to this Agreement shall increase in an amount proportionate to any increase in the total ad valorem taxes collected by Lubbock County, but in no case shall the portion paid by Lubbock County exceed twenty four percent (24%) of the total budget of the library system The $500,000.00 paid by Lubbock County toward Achieving the Goal shall be deducted from this sum. 4. This Amendment shall be effective October 1, 1998. The remainder of the Contract shall remain in full force and effect except as amended herein.. EXECUTED the 2Znd day of �c r„ 1998.
