RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal and public use and purposes, to -wit: for the widening of Wd Street,
I- 27 to Avenue U, and the City Council of said City finds it in the public interest and for
public purposes and municipal purposes to proceed with the acquisition of such lands as
needed for such purposes as aforesaid: NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described tract of land
located in Lubbock County, Texas, be acquired for public purposes and municipal
purposes as set forth in the preamble hereof, to -wit:
A 11,053.21 square foot tract out of a 5.083 acre tract located in Section 9, Block
E, Lubbock County, Texas, being the proposed right-of-way for 8e Street, being
further described by metes and bounds as follows:
BEGINNING at a "PK" nail set in the South right-of-way line of Wd Street which
bears S. 00°01'54" E. 40.00 feet from the Northwest corner of the Northeast
Quarter of Section 9, Block E, Lubbock County, Texas;
THENCE S.89°57'29" E., along said South right-of-way line, a distance of 572.61
feet to a'/2" rod with cap set for a point of intersection;
THENCE S. 87°32'12" W., along the proposed South right-of-way line of 82°d
Street, a distance of 324.02 feet to a'/2" rod with cap set for a point of
intersection;
THENCE Southwesterly, along said proposed right-of-way line, around a curve to
the right, said curve having a radius of 875.21 feet, a central angle of 02°30'21 ",
tangent lengths of 19.14 feet and a chord distance of 38.27 feet to a'/2" rod with
cap set for a point of tangency;
THENCE N. 89°57'29" W., along said proposed right-of-way line, a distance of
144.99 feet to a'/2" rod with cap set for a point of curvature;
THENCE Southwesterly, along said proposed right-of-way line, around a curve to
the left, said curve having a radius of 30.00 feet, a central angle of 90°00'28",
tangent lengths of 30.00 feet and a chord distance of 42.43 feet to a'/2" rod with
cap) set for a point of tangency in the proposed East right-of-way line of Avenue
THENCE S. 00°02'05" W., along said proposed right-of-way line, a distance of
60.62 feet to a'/2" rod with cap set for a point of intersection;
THENCE S. 02°08'15" W., along said proposed right -of way line, a distance of
46.83 feet to a'/2" rod with cap set in the South line of said 5.083 acre tract;
THENCE N. 89°57'29" W., along the South line of said 5.083 acre tract; a
distance of 33.75 feet to a'/z" rod with cap set in the West line of the Northeast
Quarter of Section 9 for the Southwest corner of said 5.083 acre tract;
THENCE N. 00°01'54" W., along the West line of said 5.083 acre tract and the
West line of the Northeast Quarter of Section 9, a distance of 152.42 feet to the
POINT OF BEGINNING.
SECTION 2. THAT the owner of said tract, being LOVELLE G. OWENS, BE offered
through the Right -of -Way Department of the City of Lubbock the amount of $35,750.00,
which is the amount appraised as the value and total damages for the fee simple title and
acquisition of said real estate purposes herein stated, and unless accepted forthwith, the
City Attorney of said City of Lubbock is hereby authorized and instructed to institute
condemnation (eminent domain) proceedings to acquire the easement.
