HomeMy WebLinkAboutResolution - 5778 - Interlocal Cooperative Agreement - City Of Abernathy - 02/26/1998RESOLUTION NO. 5778 Item #25 February 26, 1998 .RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Cooperative Agreement by and between the City of Lubbock and the City of Abernathy and all related documents. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. M114DY-SOR ATTEST: Ka i Darnell, City Secretary APPROVED AS TO CONTENT: Bob Cass, City Manager APPROVED AS TO FORM: Amy L ims, fs—sisfant City Attorney ALS:dk/abemathses ccdocs/January 15, 1998 RESOLUTION N0.5778 Item 425 February 26, 1998 INTERLOCAL COOPERATIVE AGREEMENT BY AND BETWEEN THE CITY OF LUBBOCK AND THE CITY OFABERNATHY This Agreement entered into this 12th day of JANUARY 1998, by and between the CITY OF LUBBOCK, a Texas Home Rule Municipal Corporation (hereinafter called "City of Lubbock") and the CITY OF ABERNATHY, a Texas Municipal Corporation, (hereinafter called "City of Abernathy"). WHEREAS, the establishment of the Southwest to Northwest International Trade Corridor (hereinafter called "the Corridor") has the potential of being an important and viable transportation link by and between Mexico, Canada, and the United States; and WHEREAS, the establishment of the Corridor through the West Texas area could promote economic development for the cities and counties of this area; and WHEREAS, it is necessary to employ an engineering firm to conduct a study (hereinafter called "the Study") to survey the feasibility of establishing the Corridor; and WHEREAS, the parties desire to investigate the feasibilty of establishing the Corridor and are willing to fund the Study and any associated administrative expenses. NOW THEREFORE, it is agreed between the parties hereto that: I. SCOPE OF SERVICE A. City of Abernathy Responsibilities: City of Abernathy agrees to pay $ 1 , 661.00 which is its proportional share of the expenses by population for the to y, ity of Abernathy agrees that said funds may be used for the funding of the Study and any or all operational costs or administrative expenses incurred by the City of Lubbock in implementing and administering the Study and incurred in the lobbying for or the promotion of the Corridor. B. City of Lubbock Responsibilities: City of Lubbock shall provide administrative services associated with the Study including any expenses related to the promotion and lobbying for the Corridor. The City of Lubbock shall also fund its proportional share of funding the Study and other related expenses. II. GENERAL CONDITIONS A. Term The term of this agreement shall be one (1) year from the date of execution. The parties agree that this Agreement may be renewed or extended as may be necessary. B. Responsibility The parties shall 'be responsible for their own respective claims, actions, suits, charges and judgments whatsoever that arise out of their respective performance or nonperformance of the subject matter called for under this Agreement. C. Amendments City of Lubbock or City of Abernathy may amend this agreement at any time, provided that such amendments make specific reference to this Agreement, and are executed in writing, signed by a duly -authorized representative of both organizations and approved by the City of Lubbock Council or City of Abernathy City Council if required by law. Such amendment shall not invalidate this Agreement, nor relieve nor release City of Lubbock or City of Abernathy from its obligations under this Agreement. D. Revenues The parties agree hereto that all payments made pursuant to this Agreement must be made from current revenues available to each respective party. All revenues received by the City of Lubbock pursuant to this Agreement shall be placed in a special project fund in the City of Lubbock's general multi-purpose account. The City of Lubbock agrees to conduct an annual audit on the funds received pursuant to this Agreement. The status of funding shall be made available for City of Abernathy's review. E. As you know, solidifying our coalition will further our efforts to study the potential of a Northwest to Southwest corridor. Lubbock continues to work with its West Texas cities and counties to secure interlocal agreements for the possible future expansion of I-27. Thus far, we have collected interlocal agreements from New Deal, Lubbock County, Plainview, Hale County, Swisher County, Tulia and Randall County. We continue to talk to Congressman Combest and feel confident that he and other elected officials will make every effort to obtain "high priority corridor" designation during the of ISTEA. As you know, obtaining "high priority corridor" designation and the economic implications a corridor might have through this region, are just a few reasons why we feel it's important to work closely with our West Texas neighbors. Our working together to form an alliance and united front for better transportation in this region are important steps we are taking today for the future of West Texas. We agree with your recommendation to work with other cities located near I-27. If you recall, during my presentation to your City Council I mentioned that once the study is complete we will begin adding to our coalition South of Lubbock and North of Amarillo. Please continue to share any other thoughts on this issue so we can pursue. We will continue to work with the remaining cities and counties along I-27 and bring closure to the interlocal agreements with each of them. Thank you for your support! We have opted to participate in this program for the next year, however, we strongly recommend that other cities located within reasonable distances from I -27 be asked to join in this project in that they most certainly would benefit from the International Trade Corridor.
