HomeMy WebLinkAboutResolution - 6303 - Interlocal Cooperative Agreement - Sterling County - 05/13/1999Resolution No, 6303 Item No. 27 May 13, 1999 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Cooperative Agreement by and between the City of Lubbock and County of Sterling. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Passed by the City Council this 13th day of May , 1999. / i _. /�►a r►'MAYOR ATTEST: 4t, I Lk Kayt I Darnell, City S cretary APPROVED AS TO CONTENT: Tommy Goijkalez, Vireeffir of Civic Services APPROVED AS TO FORM: ALS: cdXterlocal-S ccdocs/May 4, 1999 Resolution No. 6303 01 Item No. 27 May 13, 1999 INTERLOCAL COOPERATIVE AGREEMENT BY AND BETWEEN THE CITY OF LUBBOCK AND STERLING COUNTY This Agreement entered into this 13th day of May , 1999, by and between the CITY OF LUBBOCK, a Texas Home Rule Municipal Corporation (hereinafter called "City of Lubbock") and the STERLING COUNTY, a Political Subdivision of the State of Texas, (hereinafter called "Sterling County"). WHEREAS, the establishment of the Southwest to Northwest International Trade Corridor (hereinafter called "the Corridor") has the potential of being an important and viable transportation link by and between Mexico, Canada, and the United States; and WHEREAS, the establishment of the Corridor through the West Texas area could promote economic development for the cities and counties of this area; and WHEREAS, itis necessary to employ an engin Bering firm to conduct a study (hereinafter called "the Study") to survey the feasibility of establishing the Corridor; and WHEREAS, the parties desire to investigate the feasibility of establishing the Corridor and are willing to fund the Study and any associated administrative expenses. NOW THEREFORE, it is agreed between the parties hereto that: 1. SCOPE OF SERVICE A. Sterling County Responsibilities: Sterling County agrees to pay $143.34, which is its proportional share of the expenses by population for the Study. Sterling County agrees that said funds may be used for the funding of the Study and any or all operational costs or administrative expenses incurred by the City of Lubbock in implementing and administering the Study and incurred in the lobbying for or the promotion of the Corridor. B. City of Lubbock Responsibilities: City of Lubbock shall provide administrative services associated with the Study including any expenses related to the promotion and lobbying for the Corridor. The City of Lubbock shall also fund its proportional share of funding the Study and other related expenses. 11. GENERAL CONDITIONS A. Tern: The term of this agreement shall be one (1) year from the date of execution. The parties agree that this Agreement may be renewed or extended as may be necessary. B. Hold Harmless The parties shall be responsible for their own respective claims, actions, suits, charges and judgments whatsoever that arise out of their respective performance or nonperformance of the subject matter called for under this Agreement. C. Amendments City of Lubbock or Sterling County may amend this agreement at any time, provided that such amendments make specific reference to this Agreement, and are executed in writing, signed by a duly -authorized representative of both organizations and approved by the City of Lubbock Council or Sterling County Commissioners Court if required by law. Such amendment shall not invalidate this Agreement, nor relieve nor release City of Lubbock or Sterling County from its obligations under this Agreement. D. Revenues The parties agree hereto that all payments made pursuant to this Agreement must be made from current revenues available to each respective party. All revenues received by the City of Lubbock pursuant to this Agreement shall be placed in a special project fund in the City of Lubbock's general multi-purpose account. The City of Lubbock agrees to conduct an annual audit on the funds received pursuant to this Agreement. The status of funding shall be made available for Sterling County's review. E. Compliance The City of Lubbock and Sterling County agree to comply with all applicable federal, state and local laws and regulations governing the funds provided under this Agreement.
