RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the. Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute on behalf of the City of Lubbock an Interlocal Agreement and any
associated documents for various governmental services by and between the City of
Lubbock and Lubbock -Reese Redevelopment Authority, which Agreement is attached
hereto and which shall be a part of this Resolution as if fully copied herein in detail.

INTERLOCAL COOPERATION AGREEMENT

THIS AGREEMENT is entered into on the ?r -A day of ,
1999, by and between Lubbock Reese Redevelopment Authority, hereinafter called "Reese," and
the City of Lubbock, Texas, hereinafter called "City," both parties being political subdivisions of
the State of Texas, pursuant to the authority granted by and in compliance with the provisions of
the Interlocal Cooperation Contracting Act, Chapter 791, Government Code, and in furtherance
of the purposes of said parties as provided by law.
WHEREAS, Reese and the City desire to cooperate in the provision of various
governmental services, including water utility and sewer repairs and improvements, street
maintenance services, solid waste services, and fire prevention and suppression services within
the jurisdiction of Reese, which are governmental functions that each party to this agreement is
authorized to perform individually; NOW THEREFORE:
WITNESSETH:
1. PURPOSE. The purpose of this agreement is to cooperate in the provision of
governmental services between the City and Reese to insure that infrastructure and other services
are properly maintained or performed and do not deteriorate.
2. APPLICABLE LAW. For purposes of this agreement, the laws pertaining to
bidding applicable to Texas municipalities are to be applied.
3. GOVERNMENTAL FUNCTIONS AND SERVICES PROVIDED.
(a) Water Utilities and Streets Maintenance. The City shall provide water and sanitary
sewer system repairs and improvements and street maintenance services upon receipt of a written
work order from Reese. The City will provide cost estimates if desired by Reese and shall
endeavor to perform the work at or below the cost estimate. However, charges shall be based on
actual personnel costs times a 1.3 benefits multiplier, actual material costs times a 1.1
administration multiplier, vehicle mileage based on 2 times the length of FM 2255 from I-27 to
Quitsna Drive and hourly and/or daily equipment rates using a rate sheet submitted to Reese
prior to beginning any work under this agreement and thereafter on or before April 1 of each
subsequent year of this agreement.
(b) Solid Waste. The City shall provide solid waste services for Reese at the same
rates charged within the City limits. Reese shall provide for exclusive solid waste services by the
City in any agreements it may have with third parties for solid waste services within Reese.
Dumpster locations shall be mutually agreed upon. However, the City shall not be responsible
for wear or damage to pavement cause by routine operation of solid waste vehicles.
(c) Fire Prevention and Suppression. The City shall provide fire prevention and fire
suppression services for Reese. Fire prevention services, including flow testing and preventative
maintenance of all fire hydrants, annual fire hazard surveys of all buildings and annual target
hazard inspections and preplanning for 10 buildings shall be for a fee of $15,730.00 per year to
be paid in four equal installments due by the 10' day of the first month of each calendar quarter.
Initial services provide prior to January 1, 2000, shall be paid by the 10' day of January, 2000,
based upon the prorated portion of the above stated annual amount for which services were
rendered in 1999. Fire suppression services shall be provided from existing fire stations within
the City. Reese shall provide the City with access to the Reese Fire Station for storage and
deployment of fire suppression equipment as deemed appropriate and necessary by the Lubbock
Fire Chief or his designee. The City shall invoice Reese $3,384.00 per fire response. As provided
by Section 791.006 of the Government Code, Reese shall be responsible for any civil liability
arising from the furnishing of fire protection services as it is the governmental entity that would
have been responsible for furnishing such services in the absence of this interlocal agreement.
4. PAYMENT FOR GOVERNMENTAL FUNCTIONS AND SERVICES.
Except as otherwise provided above, Reese shall pay the City for such governmental
functions and services as are performed at Reese within 45 days of receipt of an invoice from the
City. Receipt of the invoice shall be deemed to be two days after the invoice is placed in the U.S.
Mail by the City. Any payments made pursuant to this interlocal agreement shall be made from
current revenues available to the paying party.
5. TERM. The term of this agreement shall be from the date of execution by both .
parties through December 31, 2003.
6. EARLY TERMINATION. Either party to this agreement may terminate it upon
thirty (30) days written notice to the other party. However, any expenditures or obligations
already incurred by the City pursuant to this agreement prior to the time of receipt of notification
shall be paid in full by Reese.
7. INDEMNIFICATION. Reese agrees to hold the City harmless and shall be
responsible for any civil liability or other claim of any kind arising out of the performance of this
agreement on Reese property.
