HomeMy WebLinkAboutResolution - 6472 - Approve Water Craft Rental Rates At City Parks - 08/26/1999Resolution No. 6472 - Aug. 26, 1999 Item No. 23 RESOLUTION WHEREAS, the Park and Recreation Board of the City of Lubbock pursuant to Sec. 2-259 of the Code of Ordinances has recommended fees for water craft rentals at various parks within the City of Lubbock; and WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to adopt the fees recommended by the Park and Recreation Board for water craft rentals; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council of the City of Lubbock hereby approves the following fees for water craft rentals at City parks where such activities are permitted. Vandiver, First Assistant City Attorney Mres/ccdocs/parlf'ee.res.doc July 8, 1999 Resolution No. 6472 Aug 26, 1999 City of Lubbock Item No. 23 Rental Policy for Canoes, Kayaks, and Pedal Boats Sailboats, canoes, kayaks, .pedal boats and rafts may be used on Maxey Lake, Elmore, Leftwich Lake, and Yellowhouse Canyon Lakes. Boating Requirements Only non -motorized boats are allowed in Maxey, Elmore, and Leftwich Lakes. Battery operated electric or trolling motors are allowed in the Yellow House Canyon sakes. Rental Canoes, Kayaks, and Pedal boats may be rented from the City of Lubbock Parks & Recreation Department. In order to rent any boat, an individual must: 1. Sign a waiver of Acknowledgement of Risk and Release 2. Posses a Boating Permit from the City of Lubbock Parks & Recreation Department (issued upon signing waiver) There is no fee for Boating Permit 3. Be free from the influence of drugs and alcohol 4. Be in good standing with the City of Lubbock Parks & Recreation Department (i.e. no insufficient checks, no outstanding claims for damages, etc.) 5. Meet age requirement 6. Wear a Coast Guard approved life preserver while in vessel 7. Be able to enter and exit the craft independently or with the assistance of a companion. 8. Be able to remain seated and balanced, using adaptive support if necessary. Adaptive support should affect neither the integrity nor the stability of the craft. 9. At least one person in the craft must have the ability to move it through the water in a stable manner and return it back to the launch area. lo. In the event of a capsize, all riders must have the independent ability to get out from under the craft, and the ability to right themselves and remain face up iri the water with the aid of the life preserver. 11. No rentals will be allowed when there are lake wind advisories in effect. Rates Pedal Boats $5.00 /1 hour or any portion of an hour Kayaks $5.00 Ahour or any portion Canoes $10/day or $20/week- end Age Requirement Children under two (2) years of age are not allowed to ride in rental boats. Any child 17 years or younger must be supervised by an adult 18 years of age or older. Maximum Boat Capacity Do not exceed printed weight capacity on vessel. Reservations Requests for reservations for rental boats are on a first come, first serve basis. Reservations must be paid in full in advance to secure and may not be more than 30 days in advance. Forty-eight (48) hours notice must be given in order to receive a full refund. Boat Deposit A refundable $25 damage deposit must be paid by check or money order at time of rental. Life Preserver All riders must wear a life jacket on board. Alcohol No alcohol is allowed in any watercraft. No person who is under the influence of alcohol or drugs will be allowed to rent or operate a boat. Swimming Swimming is not allowed in the lakes at anytime. Glass & Coolers Glass containers and coolers are not allowed in boats. The Pedal boats have a built in cooler which you may place bagged ice and canned drinks. If the on -board cooler is used, then you must empty all contents, bail out any water, and clean compartment. Weather / Emergency All boaters should be watch for threatening cloud build-up and that strong winds that can cause hazardous conditions. Participants must return to shore when there is lightening, strong winds, or approaching storms. Should it be necessary for the lake to be cleared due to severe weather or any emergency situation, please memorize the following: • Three blasts of horn — clear lake immediately! • One blast — all clear Equipment Inspections Staff will inspect the water craft and lifejackets prior to and after each rental. Patrons will be present at the post rental inspection. If any damages are found after the rental, the $25 damage deposit will be retained by the City. Weekly maintenance inspections will be performed by staff to ensure the safety and integrity of the equipment. EXHIBIT A City of Lubbock Canoe / Kayak / Pedal Boat Rental WAIVER, RELEASE FROM LIABILITY, and INDEMNITY AGREEMENT In consideration for myself (and/or my children/dependents) being permitted to use a canoe, kayak, or pedal boat belonging to the City of Lubbock, I DO HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE THE CITY OF LUBBOCK , ITS OFFICERS, EMPLOYEES, AGENTS, STAFF, OR VOLUNTEERS. I understand there are certain risks involved with any water -related activity, and I assume all risks associated with such activity. I am knowledgeable of how to operate the equipment of which I have rented in a safe and proper manner. I WILL INDEMNIFY AND SAVE AND HOLD HARMLESS THE CITY OF LUBBOCK, ITS OFFICERS, EMPLOYEES, AGENTS, STAFF, AND VOLUNTEERS FROM ANY LIABILITY OR INJURIES I MIGHT SUSTAIN AS A RESULT OF ACTIVITY ASSOCIATED WITH CITY OF LUBBOCK CANOEING, KAYAKING, OR PEDAL BOAT USE. I also release the City of Lubbock, its officers, employees, agents, staff, and volunteers from any and all liability actions, causes of action, debts, claims, and demands of every kind and nature whatsoever which may arise during the course or as a result of my canoeing, kayaking, or pedal boat use. I understand that I will hold harmless the City of Lubbock, its officers, employees, agents, staff, and volunteers for the negligence of any employees, agents, staff, volunteers, or patron. I have read and understand this statement fully, and I make this waiver of my rights voluntarily. I WILL INDEMNIFY AND SAVE AND HOLD HARMLESS THE CITY OF LUBBOCK, ITS OFFICERS, EMPLOYEES, AGENTS, STAFF, AND VOLUNTEERS FROM ANY LIABILITY OR INJURIES MY CHILD MIGHT SUSTAIN AS A RESULT OF ACTIVITY ASSOCIATED WITH CITY OF LUBBOCK CANOEING, KAYAKING, OR PEDAL BOAT USE. I also release the City of Lubbock, its officers, employees, agents, staff, and volunteers from -any and all liability actions, causes of action, debts, claims, and demands of every kind and nature whatsoever which may arise during the course or as a result of my child's canoeing, kayaking, or pedal boat use.
