Neighborhood Association for the installation of neighborhood identification signs. Said Contract is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Hart, Jr. fl Trak Engineer APPROVED AS TO FORM: JMK:ccdocs1UNrr-Neighboorhood Assn Signs.res July 10, 2000 CONTRACT STATE OF TEXAS COUNTY OF LUBBOCK § Resolution No. 2000-80243 July 27, 2000 Item N0. 17 This contract, (the "Contract"), effective as of the 27th day of July , 2000, (the 'Effective Date"), is by and between the City of Lubbock, (the "City"), a Texas municipal corporation, and U.N.I.T. Neighborhood Association ("U.N.I.T."). WITNESSETH WHEREAS, the City desires to promote neighborhood pride and identity; and WHEREAS, U.N.I.T. desires the installation of the neighborhood identification signs for the purpose of enhancing neighborhood pride and identity; and WHEREAS, the City agrees to manufacture and install neighborhood identity signs on street signs in the U.N.I.T. community in accordance with the term hereinafter set forth. NOW THEREFORE, for and in consideration of the terms, covenants and conditions set forth in this Contract, the City and U.N.I.T. hereby agree as follows: ARTICLE I (1) The term of this contract shall be for a period of two (2) years. (2) This agreement may be extended for an additional one-year period by mutual agreement of the parties hereto expressed in writing prior to the end of the initial term or any extension thereof. (3) Either party hereto may terminate this agreement at any time during the term of this agreement by giving sixty (60) days notice of its intention to terminate this contract. ARTICLE II 1 Contract, City of Lubbock & U.N.I.T. Neighborhood Association Signs are to be fabricated and installed by the City of Lubbock Traffic Engineering Department. ARTICLE III Cost to fabricate sign is $26.00 and will include a 6"x18" sign blank with white engineer grade background and green electronic cuttable film facing. Signs are to be faced on both sides. Cost for sign installation including materials, equipment, and labor is $13.50. Pricing will be available for two (2) years from contract date. All cost of fabrication and installation shall be paid by U.N.I.T. with the payment of the initial installation being due in full upon completion of that installation. Payment for replacement signs shall be due twice per year, on the anniversary of the contract date and on six months from that date. date. ARTICLE IV Initial sign installations will be completed One Hundred Twenty (120) days from contract ARTICLE V If signs are stolen or vandalized, and U.N.I.T. wishes replacement, then U.N.I.T. will pay for replacement expenses including fabrication and installation costs. If signs are damaged and need to be replaced because of the actions of the City, its employees, or its agents, then the City shall bear the costs of the fabrication and installation of replacement of signs. ARTICLE VI Area to have signs installed will include the street signs located between Indiana Avenue and University Avenue and between 19' Street and 34'' Street. ARTICLE VII INDEMNITY U.N.I.T. shall indemnify and save harmless the City of Lubbock and its officers, agents, and employees from all suits, actions, losses, damages, claims, or liability of any character, type, or description, including without limiting the generality of the foregoing all expenses of litigation, court costs, and attorney's fees for injury or death to any person, or injury to any property, received or sustained by any person or persons or property, arising out of, or occasioned by, the acts of U.N.I.T., its agents or employees, in the execution of this Contract. 2 Contract, City of Lubbock & U.N.I.T. Neighborhood Association ARTICLE VIII COMPLIANCE WITH APPLICABLE LAWS U.N.I.T. shall comply with all applicable federal, state and local laws, statutes, ordinances, rules and regulations relating, in any way, manner or form, to the activities under this Contract, and any amendments thereto. ARTICLE IX NOTICE A. General. Whenever notice from U.N.I.T. to City or City to U.N.I.T. is required or permitted by this Contract and no other method of notice is provided, such notice shall be given by (1) actual delivery of the written notice to the other party by hand. (2) facsimile, or other reasonable means (in which case such notice shall be effective upon delivery). or (3) by depositing the written notice in the United States mail, properly addressed to the other party at the address provided in this article, registered or certified mail, return receipt requested, in which case such notice shall be effective on the third business day after such notice is so deposited. B. U.N.I.T.'s Address. U.N.I.T.'s address and numbers for the purposes of notice are: U.N.I.T. Either party may change its address or numbers for purposes of notice by giving written notice to the other party, referring specifically to this Contract, and setting forth such new address or numbers. The address or numbers shall become effective on the 15th day after such notice is effective. ARTICLE X Entire Agreement. This Contract, contains the Entire Contract between the City and U.N.I.T., and there are no other written or oral promises, conditions, warranties, or representations relating to or affecting the matters contemplated herein. 3 Contract, City of Lubbock & U.N.I.T. Neighborhood Association CITY OF LUBBOCK MEMORANDUM TO: Richard Burdine, Assistant City Manager FROM: Jere Hart, City Traffic Engineer SUBJECT: Agenda Comments -duty 27, 2000 City Council Meeting DATE: July 14, 2000 CC: Teresa Beltran CITY OF LUBBOCK AGENDA ITEM SUMMARY CONSENT AGENDA ITEM#/SUBJECT: Consider a resolution authorizing the Mayor to execute for and on behalf of the City of Lubbock a contract with U.N.I.T. Neighborhood Association for the installation of neighborhood identification signs. BACKGROUNDIDISCUSSION: This contract allows the City to manufacture and install neighborhood identification signs at all the street comers within the U.N.I.T. Neighborhood at a contract price of $39.50. This price is the estimated cost for the City of Lubbock to provide this service. There are approximately 150 signs and the total estimated cost is $6,000 which will be paid by the U.N.I.T. Neighborhood Association. The contract also provides for replacement signs as needed to be paid for by them. This contract is a result of the U.N.I.T. Neighborhood Association's desire to enhance neighborhood identity and pride. SUMMARYIRECOMMENDATIONS: The Traffic Engineering Department recommends approval of this resolution and contract. ITEM#/SUBJECT: Second reading of proposed ordinance # 2000-00033 amending Chapter 16, Motor Vehicles and Traffic, section 175.1 so as to alter the prima facie speed limits upon certain streets within the City of Lubbock (Elm Avenue from 6iP to bel 40mph; 21't Street from Joliet to Louisville/ 20 mph; E. 6EP Street from Slaton Hwy to MLK/ 45mph) , and section 175.2 to establish a new school zone (E. 2e°1 street either We of Date -20 mph)
