HomeMy WebLinkAboutResolution - 2000-R0266 - Approve Plan For LP&L Substation At Buster Long Park Location - 07/27/2000Resolution No. 2000-R 0266 July 27, 2000 Item No. 55 WHEREAS, the City of Lubbock, a home -rule municipal corporation, in the State of Texas, owns and operates a municipal electric utility known as Lubbock Power & Light; and WHEREAS, the City of Lubbock has experienced a growth in population and demand for electric service in southwest Lubbock; and WHEREAS, the two electric substations and distribution lines operated by Lubbock Power & Light that serve southwest Lubbock is currently at maximum capacity; and WHEREAS, in order to serve the increasing demand for electric service in southwest Lubbock, the City Council of the City of Lubbock desires to increase Lubbock Power & Light's capacity to provide electric service in southwest Lubbock; and WHEREAS, the City of Lubbock owns a park bordered on the south by 58th Street, the west by Bangor Avenue, the north by 540' Street, and the east by Aberdeen Avenue, called Buster Long Park, located in southwest Lubbock; and WHEREAS, the City of Lubbock desires to build a substation on a portion of Buster Long Park; and WHEREAS, the park facilities currently located on Buster Long Park will be relocated to a less congested area at McAlister Park that better serves not only the park patrons and participants, but the public at large as well; and WHEREAS, Lubbock Power & Light has agreed to use a portion of the budgeted savings from building a substation at Buster Long Park to build new park facilities at McAlister Park; and WHEREAS, the Parks and Recreation Board of the City of Lubbock has approved the plan as submitted by Lubbock Power & Light to build a substation at Buster Long Park; and WHEREAS, the City Council of the City of Lubbock, as the governing body of the City of Lubbock, believes that it is in the best interest of the health, safety and welfare of the citizens of Lubbock to build a substation on a portion of Buster Long Park; and WHEREAS, the City Council of the City of Lubbock, as the governing body of the City of Lubbock and pursuant to Chapter 26 of the Texas Parks and Wildlife Code, desires to adopt this RESOLUTION changing a portion of the use of Buster Long Park to an electric substation; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Lubbock Power & Light must increase its capacity to provide electric service in southwest Lubbock. SECTION 2. THAT, after hearing the testimony and evidence presented to the City Council of the City of Lubbock, the City Council determines that there is no other feasible and prudent alternative to locating an electric substation on a portion of Buster Long Park. SECTION 3. THAT, after hearing the testimony and evidence presented to the City Council of the City of Lubbock, the City Council determines that the project to build a substation at Buster Long Park includes all reasonable planning to minimize the harm to Buster Long Park. SECTION 4. THAT the City Council of the City of Lubbock, as the governing body of the City of Lubbock, has considered the clearly enunciated local preferences regarding changing the use of a portion of Buster Long Park to build an electric substation for Lubbock Power & Light. SECTION S. THAT the City Council of the City of Lubbock, as the governing body of the City of Lubbock, believes that it is in the best interest of the health, safety and welfare of the citizens of Lubbock to build a substation on a portion of Buster Long Park. SECTION 6. THAT on the 27th day of July, 2000, pursuant to Chapter 26 of the Texas Parks and Wildlife Code, the City Council of the City of Lubbock held a public hearing in the council chambers to consider changing the use of a portion of Buster Long Park to that of an electric substation. SECTION 7. THAT, pursuant to § 26.002(c) of the Texas Parks and Wildlife Code, notification of this hearing was published in the newspaper of general circulation once a week for three consecutive weeks prior to the date of this hearing. SECTION 8. THAT, pursuant to § 26.002(a) of the Texas Parks and Wildlife Code, notice of this hearing was given to each person, organization, department, or agency that has supervision over Buster Long Park.
