HomeMy WebLinkAboutResolution - 2000-R0257 - Interlocal Agreement - LECD, LCAD - Sharing Geographic Information Systems - 07/27/2000Resolution No. 2000-R-0257 July 27, 2000 RESOLUTION Item No. 31 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Agreement between the City of Lubbock (City), Lubbock Emergency Communication District (LECD), and Lubbock Central Appraisal District (LCAD), for sharing Geographic Information Systems, and any other related documents. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Chamales Supervising Attorney — Office Practice gs/ccdocs/Interlocal Agrmt-Geographic Info Sys.res June 9, 2000 Resolution No. 2000— R0257 July 27, 2000 Item No. 31 INTERLOCAL AGREEMENT FOR SHARING GEOGRAPHIC INFORMATION SYSTEMS THIS AGREEMENT is entered into on the 27th day of July , 2000, by and between the City of Lubbock (City), Lubbock Emergency Communication District (LECD), and Lubbock Central Appraisal District (LCAD), each being political subdivisions of the State of Texas, pursuant to the authority granted by and in compliance with the provisions of the Interlocal Cooperation Act, Chapter 791, Government Code, and in furtherance of the purposes of these parties as provided by law. WHEREAS, the City, LECD and LCAD share a common area of geographic interest, and WHEREAS, technological advances have made it possible for the three agencies to share information, including maps, and WHEREAS, the parties desire to share the same base and parcel maps of Lubbock County and other data of mutual interest; NOW THEREFORE, the parties agree to the following: 1. PURPOSE. The purpose of this agreement is to create a mechanism for interagency data sharing, including but not limited to, digital maps of the City of Lubbock and Lubbock County. 2. TERM. The term of this agreement is for a period of five (5) years commencing on the date of execution of the Agreement, subject to earlier termination as provided in paragraph 6. This Agreement may be extended for five (5) successive terms of five (5) years each upon written agreement of all parties. 3: CITY RESPONSIBILITIES. a. The City will be responsible for creation and maintenance of base and parcel maps of the City of Lubbock to the outer boundary of the mile including the city limits. The City will maintain a futures map layer of this area and database records for parcels inside the city limits. Interlocal GIS Sharing Agreement Page 1 b. The City will provide monthly updates of base and parcel maps to LCAD, along with any data needed from the Land Use database and/or GIS projects. c. The City will provide LECD a connection to its fiber network and access to GIS files, including base maps, parcel maps, land use data and any other data sets available to City users. If a fiber connection is not feasible or desirable at some point in the future, the City will provide LECD similar information in another format. d. Upon receipt of geo numbers for new plats and accounts, the City of Lubbock will add the new parcels to the city's base maps and parcel maps within a month, and return that information to LCAD within 60 days. e. The City, LECD and LCAD will exchange data monthly. f. Data exchange from City to LCAD will include but will not be limited to parcel and base maps that include plats processed during the preceding month, building and demolition permits from the preceding month, recorded plats with addresses assigned, and land use information. g. The City will provide paper copies of recorded plats to LECD and LCAD. J h. The City will provide zoning information to LCAD when that information becomes available in digital format. i. City will provide digital orthophotography, planemetric data and positional control from the City of Lubbock digital ortho project scheduled for 2000-2001 as requested by LCAD and LECD. 4. LCAD RESPONSIBILITIES. a. LCAD will provide adequate documents to allow creation of maps and database records for splits and combinations and platted and of unplatted properties inside the city limits and outside the city limits within the city's maintenance responsibility. b. LCAD will provide information to the City that will allow them to create a futures map layer and database. c. Using the map information provided by the City, LCAD will maintain a map layer and database for the LCAD certified tax roll that will be frozen at the date of certification each year. After certification, LCAD will provide the City of Lubbock with a copy of the certified roll maps and database. d. CAD will assign geo numbers for new plats within a month of receiving the recorded plat to aid the City Of Lubbock in timely map updates. Other new accounts will be created as deed records are received, and information will be forwarded to the City of Lubbock. In addition, LCAD will develop a futures database of owners of new accounts for use in the city database. e. The City, LECD and LCAD will exchange data monthly. Data exchange from LCAD to City will include but will not be limited to new and changed accounts, tax values, geo numbers, sales data (excluding sale amounts), ownership data, and exemption data, g. LCAD will provide City with notice, as soon as reasonably practical, but no later than 60 days after the occurrence of any geo number changes and/or reassignments. h. LCAD will provide property structure photo images annually, if available and economically feasible, for each property if and when the City decides to use those images. 5. LECD RESPONSIBILITIES. a. LECD will transfer responsibility for rural mapping to LCAD, along with any .completed map and address information. This transfer will occur on a map -by - map basis. Once LECD completes all data validation and geospatial refinements to a map, it will transfer maintenance responsibilities to LCAD. The entire process should be complete no later than September 2001. b. The City, LECD and LCAD will exchange data monthly. c. Data exchanged from LECD to LCAD shall include, but not be limited, any maps created by LECD and rural addresses. 6. MUTUAL RESPONSIBILITIES a. The City, LECD or LCAD may request a link on each other's website, and shall provide a similar link in return. The host agency, however, will determine the format and location of each link. b. The City, LECD and LCAD will work together to resolve any technical difficulties encountered in the implementation of this agreement and in the sharing of additional data of mutual interest. 7. AMENDMENT. This Agreement may be amended or modified by the mutual consent of all the parties hereto in writing to be attached to and incorporated into this Agreement. 8. TERMINATION. It is further agreed by and between the parties hereto that any party shall have the right to terminate this Agreement for any reason without penalty upon thirty (30) days written notice to the other part of such intention to terminate. 9. INDEMNIFICATION. To the extent authorized by law, the parties shall each hold the other harmless from any claim or damages of any nature whatsoever arising from the acts of its own officials and employees in connection with this agreement. Even though this agreement contemplates no payments, any payments that should be required shall be made from current revenues available to the paying party. EXECUTED this 27th day of _ July , 2000.
