RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in.
Lubbock County, Texas, has determined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal public use and purposes, to -wit: for public park purposes, and the City
Council of said City finds it in the public interest and for public purposes and municipal
purposes as set forth in the preamble hereof, to -wit: NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to following described parcel of land
located in Lubbock County, Texas, be acquired for public purposes and municipal
purposes as set forth in the preamble hereof, to -wit:

Lubbock Independent School District, a Municipal Corporation $65,000.00
SECTION 2. LEGAL DESCRIPTION: A tract of land out of the Southwest
quarter (SWI/4) of Section 6, Block E, Lubbock County, Texas, and more particularly
described by metes and bounds, as follows:
BEGINNING at an iron pipe found 660 feet East of the Northwest corner of the
Southwest 1/4 of said Section 6; said pipe being the Northeast corner of a 10 acre
tract, and the Northwest corner of this tract;
THENCE South 660 feet to an iron pipe for the Southwest corner of this tract;
THENCE East 660 feet to a point for the Southeast corner of this tract;
THENCE North 660 feet to an iron pipe set for the Northeast corner of this tract;
THENCE West 660 feet to the place of beginning, and containing 10 acres.
SECTION 3. THAT the owners of above-described parcel of land being the
Lubbock Independent School District BE offered through the Right -of -Way
Department of the City of Lubbock the amount hereinabove indicated for their respective
parcel, which is the amount appraised as the value and total damages for the granting of
fee simple title, including all legal obligations attached thereto, for the use and benefit of
the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith,
the City
Attorney of said City of Lubbock is hereby authorized and instructed to institute
condemnation (eminent domain) proceedings to acquire the fee simple title to any or all
such parcels as hereinabove described for public purposes and municipal purposes,

# Consider a resolution authorizing the Right-of-way Department to make an
offer to the Lubbock Independent School District for 10 acres of land for a
City Park located in Section 6, Block E, Lubbock County (7401 Cedar
Avenue).
BACKGROUND/DISCUSSION:
The recent Bond election provided for the acquisition of several new parks
throughout the City. One such park is to be located at the southeast corner of
East 74"' Street and Cedar Avenue. This 10 -acre vacant land tract is owned by
the Lubbock Independent School District and was appraised by Gary Phillips,
MAI for $65,000 or $6,500 per acre. The LISD has approved this sale to the City
for $65,000.
SUMMARY/RECOMMENDATION:
The Right -of -Way Department recommends the approval of our offer to the LISD.
