HomeMy WebLinkAboutResolution - 2000-R0313 - Right-Of-Way Offer - Ron & Rick Betenbough - Public Parks - 09/13/2000Resolution No. 2000-R 0313 September 13, 2000 Item No. 30 RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public use and purposes, to -wit: for public park purposes, and the City Council of said City finds it in the public interest and for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to following described parcel of land located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: OWNER'S NAME Ron Betenbough and Rick Betenbough AMOUNT $170,000.00 SECTION 2. THAT the above-described parcel of land whose acquisition is herein authorized is more particularly described in "Exhibit A" attached to this Resolution and incorporated herein as part of this Resolution. SECTION 3. THAT the owners of above-described parcel of land being Ron Betenbough and Rick Betenbough BE offered through the Right -of -Way Department of the City of Lubbock the amount hereinabove indicated for their respective parcel, which is the amount appraised as the value and total damages for the granting of fee simple title, including all legal obligations attached thereto, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Z ` V Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to any or all such parcels as hereinabove described for public purposes and municipal purposes, Passed by the City Council this 13th da of septembe , 2000. BACKGROUND/DISCUSSION: This 7.928 -acre tract of land is being purchased for a park site in the Northridge School area. This area is north of 19th Street, south of 11"' Street, between Milwaukee Avenue and Iola Avenue. This park site was appraised by Tommy Cantrell, MAI for $170,000. This equates to approximately $21,443 per acre. He utilized recent sales of subdivision and acreage land in the surrounding area. Large acreage sales were around the $5,000 to $7,000 per acre range while small acre sales were in the $20,000 to $27,000 range. Therefore, our offer to the Betenbough's is $170,000. SUMMARY/RECOMMENDATION: The Right -of -Way Department recommends the approval of our offer to Ron and Rick Betenbough.
