RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal public use and purposes, to -wit: for public park purposes, and the City
Council of said City finds it in the public interest and for public purposes and municipal
purposes as set forth in the preamble hereof, to -wit: NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK

SECTION 2. THAT the above-described parcel of land whose acquisition is
herein authorized is more particularly described as follows:
METES AND BOUNDS DESCRIPTION of a 10.332 acre tract of land Iocated in
Section 1, Block J -S, Lubbock County, Texas, being a portion of a 130.00 acre
tract described in Volume 4191, Page 146, Real Property Records of Lubbock
County, Texas, said 10.332 acre tract being further described as follows:
BEGINNING at an 80 -penny nail found in the existing North right-of-way line of
Auburn Street, in a South line of said 130.00 acre tract which bears West a
distance of 2666.4 feet and North a distance of 2640.0 feet from the Southeast
corner of said Section 1, said point also bears N. 89°58'13" W. a distance of
1648.10 feet from the Southeast corner of said 130.00 acre tract;
THENCE N. 0001'47" E. a distance of 592.95 feet to a 112" iron rod with cap set
for the Northwest corner of this tract;
THENCE S. 89058'13" E. a distance of 759.00 feet to a 112" iron rod with cap set
for the Northeast corner of this tract;
THENCE S. 0001'47" W. a distance of 592.95 feet to a 112" iron rod with cap set
in the South line of said 130.00 acre tract for the Southeast corner of this tract;
THENCE N. 89058'13" W., along the South line of said 130.00 acre tract a
distance of 759.00 feet to the POINT OF BEGINNING.
SECTION 3. THAT the owner of above-described parcel of land being H.A.
Sessions, BE offered through the Right -of -Way Department of the City of Lubbock the
amount hereinabove indicated for their respective parcel, which is the amount appraised
as the value and total damages for the granting of fee simple title, including all legal
obligations attached thereto, for the use and benefit of the City of Lubbock, Texas, for the

purposes herein stated, and unless accepted forthwith, the City Attorney of said City of
Lubbock is hereby authorized and instructed to institute condemnation (eminent domain)
proceedings to acquire the fee simple title to any or all such parcels as hereinabove
described for public purposes and municipal purposes.

# Consider a resolution authorizing the Right -of -Way Department to make an
offer to H. A. Sessions for a 10.332 acre tract of land for a City Park in
Section 1, Block J -S, Lubbock County, Texas (5402 Auburn Street).
BACKGROUND/DISCUSSION:
This 10.332 -acre tract of land is being purchased for a park site in the Horizon
West/West Wind Addition area. This park site is north of Auburn Street along the
east side of Chicago Avenue. Gary Phillips, M.A.I., appraised this park site for
$70,000. This equates to approximately $6,800 per acre. Mr. Phillips utilized
recent sales of acreage land in the surrounding area. Therefore, our offer to Mr.
Sessions is $70,000.
SUMMARY/RECOMMENDATION:
The Right -of -Way Department recommends the approval of our offer to H. A.
Sessions.
