HomeMy WebLinkAboutResolution - 2000-R0368 - Right Of Way Offer - Iva Ruth York - LPD Firing Range - 10/12/2000Resolution No. 2000-RO368 October 12, 2000 RESOLUTION Item No. 49 WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public use and purposes, to -wit: for Lubbock Police Department Firing Range, and the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described tract of land located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: 97.41 acres of land out of Section 47, Block P, and Section 13, Block D-6, situated in Lubbock, Lubbock County, Texas, and more fully described in the attached "Exhibit A". SECTION 2. THAT the owner of said tract, being Iva Ruth York, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $73,000 which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title. JOB 00-0533D Larry Hertel, City Engineer Agenda Items and Comments — City Council Meeting for October 12, 2000 Page 9 CITY OF LUBBOCK AGENDA ITEM SUMMARY ITEM #ISUBJECT # Consider a resolution authorizing the Right -of -Way Department to make an offer to Iva Ruth York for 97.41 acres of land in Section 47, Block P and Section 13, Block D-6, Lubbock County, Texas for a Lubbock Police Department Firing Range (west of Reese Center on 19°h Street). BACKGROUND/DISCUSSION: This tract of land is being purchased for the firing range clear zone. This property is farmland and was appraised by Jim Bowman, M.A.I. for $73,004 or $750 per acre. This appraised value was taken from market sales in the immediate area. Therefore, our offer to Mrs. York is $73,004. This resolution also authorizes condemnation proceedings to acquire this property if our offer is refused. SUMMARY/RECOMMENDATION: The Right -of -Way Department recommends the approval of our offer to Mrs. York.
