RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal public use and purposes, to -wit: for Lubbock Police Department
Firing Range, and the City Council of said City finds it in the public interest and for
public purposes and municipal purposes to proceed with the acquisition of lands as
needed for such purposes as aforesaid NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described tracts of land
located in Lubbock County, Texas, be acquired for public purposes and municipal
purposes as set forth in the preamble hereof, to -wit:
150.94 acres of land out of Section 47, Block P, and Section 13, Block D-6,
situated in Lubbock County, Texas, and more fully described in the attached "Exhibit A".
SECTION 2. THAT the owners of said tracts, being the Estate of Kate
Lindsey, deceased, Iva Ruth York, and Mary Lou Gentry, BE offered through the
Right -of -Way Department of the City of Lubbock the amount of $121,000 which is the
amount appraised as the value and total damages for the fee simple title and acquisition
of said real estate purposes herein stated, and unless accepted forthwith, the City
Attorney of said City of Lubbock is hereby authorized and instructed to institute
condemnation (eminent domain) proceedings to acquire the fee simple title.

# Consider a resolution authorizing the Right -of -Way Department to make an
offer to the Estate of Kate Lindsay, Deceased, Iva Ruth York and Mary Lou
Gentry for 150.94 acres of land in Section 47, Block P, Lubbock County,
Texas for a Lubbock Police Department Firing Range (west of Reese Center
on 19'h Street).
BACKGROUND/DISCUSSION:
This tract of land is being purchased for the firing range clear zone. This
property is farmland and was appraised by Jim Bowman, MAI for $12.1,000 or
$800 per acre (rounded). Therefore, our offer to the property owners is
$121,000.
This resolution also authorizes condemnation proceedings to acquire this
property if our offer is refused.
SUMMARY/RECOMMENDATION:
The Right -of -Way Department recommends the approval of our offer to the
property owners.
