HomeMy WebLinkAboutResolution - 2000-R0362 - Right Of Way Offer - Golombeck, Payne, Vallado, Clopton, May - 10/12/2000Resolution No. 2000-RO362 October 12, 2000 Item No. 43 RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public use and purposes, to -wit: for 98' Street widening project from Indiana Avenue to University Avenue and the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title and U. U. E. /S. E. E. easement to the tracts of land further described in Exhibit "A" and Exhibit "B" attached hereto, be acquired for public purposes and municipal purposes as set forth in the preamble hereof. SECTION 2. THAT the owner of said tracts, being Richard S. Golombeck, Richard A. Golombeck Trust, Sara M. Golombeck Trust, Anne M. Payne, Jan Clopton Vallado, Russell Wallace Clopton, Lewis G. May, Arthur A. May, and Suzanne M. Sylvester, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $30,672.00 which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate purposes and U.U.E./S.E.E. easement herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title and U.U.E./S.E.E. easement. Golombeck, Richard A. Golombeck Trust, Sara M. Golombeck Trust, Anne M. Payne, Jan Clopton Vallado, Russell Wallace Clopton, Lewis G. May, Arthur A. May and Suzanne M. Sylvester for a 4,941 sq. ft. tract of land for 98th& University and an underground utility easement/switch enclosure easement for LP&L, land and easement located at the southeast corner of 98th and University Avenue in Section 10, Block E, Lubbock County, Texas (9801 University). BACKGROUND/DISCUSSION: The City of Lubbock is in the beginning stages of acquiring right-of-way for the widening of 98`h Street from University Avenue westward to Indiana Avenue. This right-of-way includes fee simple takings and electrical easements for Lubbock, Power, and Light. There are about ten parcels to be acquired for this project. This first resolution is for a 4,941 -sq. ft. parcel of land for the northbound turn lane at the southeast corner of 98'h Street and University Avenue. This resolution also includes an underground utility easement/switch enclosure easement for L. P. & L. also located at that intersection. Deck Goddard appraised these properties and Shaw Wofford reviewed the appraisals. The 4,941 -sq. ft. fee simple taking was appraised for $29,893 and the U. U. E. /S. E. E. was appraised for $779.00 for a total offer to the above named property owners of $30,672. This resolution also authorizes condemnation proceedings to acquire this property if our offer is refused. SUMMARY/RECOMMENDATION: The Right -of -Way Department recommends the approval of this offer to the property owners.
