HomeMy WebLinkAboutResolution - 2000-R0342 - Interlocal Agreement - Texas Tech University - 10/12/2000Resolution No. 2000-RO342 October 12, 2000 Item No. 23 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Agreement, attached hereto, by and between the City of Lubbock and Texas Tech University, and any associated documents, which Contract shall be spread upon the minutes of this Council and as spread upon the minutes of this Council shall constitute and be a part hereof as if fully copied herein in detail. Vandiver, First Assistant City Attorney Mresaechstud.res September 29, 2000 Resolution No. 2000-R 0342 October 12, 2000 Item No. 23 STATE OF TEXAS § § INTERLOCAL AGREEMENT CITY OF LUBBOCK § WITNESSETH: The parties to the agreement are the City of Lubbock, Texas (hereinafter CITY) and Texas Tech University (hereinafter TTU). ARTICLE 1. STATEMENT OF WORK TTU will provide an engineering student for not less than twenty (20) hours per week for each year under this contract to do work associated with data collection and sorting, sample collection, possible testing associated with the disposal of treated effluent and sludge by agricultural application, ammonia stripping, determination of the fate of nitrogen from the wastewater plant to the land application site, analysis of crop production relative to nitrogen application, and analysis of changes in soil fertility. ARTICLE 2. PERIOD OF PERFORMANCE The initial term of this agreement shall before one (1) year commencing no later than October 16, 2000. Thereafter, this agreement may be renewed for three (3) successive terms of one (1) year upon mutual agreement of the parties expressed in writing not less than thirty (30) days prior to expiration of the prior term. ARTICLE 3. PAYMENT AND FINANCIAL REPORTING In consideration of the performance of the work set forth in Article 1, CITY agrees to pay TTU the amount of $9,600 for each year under this agreement and any additional terms hereof. Checks shall be made payable to and mailed to: Grants and Contracts Accounting Texas Tech University Lubbock, TX 79409-1105 ARTICLE 4. TERMINATION This agreement may be terminated by either party upon thirty (30) days written notice to the other party. ARTICLE 5. HOLD HARMLESS Each party hereto agrees to hold the other party harmless from any claim for damages arising out of the acts or omissions of its own agents or employees to the extent permitted by the Constitution and Laws of the State of Texas.
