'C� /0� TOM MARTIN, MAYOR PRO TEM CONTRACT NO. 6528 AMENDMENT NO.3 to CONTRACT FOR ENGINEERING SERVICES for DESIGN and BID: GLENNA GOODACRE BOULEVARD PROTECT in OVERTON PARK, LUBBOCK THE STATE OF TEXAS § THE COUNTY OF LUBBOCK § THIS AMENDMENT NO. 3 to THE CONTRACT FOR ENGINEERING SERVICES for DESIGN and BID: GLENNA GOODACRE BOULEVARD PROJECT in OVERTON PARK, LUBBOCK, said contract dated December 8, 2003 together with Amendment No. 1 dated August 24, 2004 and Amendment No. 2 dated November 4, 2004, is made by and between the City of Lubbock, Texas, hereinafter called the OWNER, and Hugo Reed and Associates, Inc., hereinafter called HRA. NOW, THEREFORE, in consideration of the mutual covenants and agreements herein contained, the OWNER and HRA do mutually agree as follows. ARTICLE 1. CONTRACT PERIOD The effective date of the original contract was December 8, 2003. This AMENDMENT NO.3 will extend the Contract Period to include the additional design phase services and those construction phase services as generally outlined herein. Unless subsequent Amendments to this Contract are executed, the Contract Period will extend to December 30, 2006, unless the additional services authorized by this amendment are completed in their entirety before said date. ARTICLE 2. SCOPE OF SERVICES This AMENDMENT NO.3 is being made at the request of the OWNER for the purpose of amending the Original Scope of Services to include those general professional services detailed in Attachment A hereto, "Additional Project Scope and Services." ARTICLE 3. COMPENSATION The general tasking proposed to perform the additional services authorized by this AMENDMENT NO.3 is described in Attachment A. The "Basis for Payment" for services performed under this Amendment is indicated in Attachment B hereto. This AMENDMENT NO. 3 will result in a net increase of $ 406,306 to the maximum amount payable under this contract. ARTICLE 4. OTHER This Amendment will affect a change to the hourly billing rates applicable to work performed under this Amendment going forward, as indicated in Attachment A, Table C, "Personnel Service Rates for Amendment No. 3 to Agreement for Engineering Services," Page 9. No changes to the original contract are requested or granted as a result of this Amendment, other than those detailed in these Amendment No. 3 to Contract for Engineering Services for Design and Bid: Glenna Goodacre Boulevard Project Page 3 Articles I through 4, above. All other provisions of the original contract will remain in full force and effect. This Amendment shall become a part of and be incorporated into the original contract upon its full execution by both OWNER and HRA. ARTICLE 5. SIGNATORY WARRANTY The undersigned signatory for Hugo Reed and Associates, Inc. hereby represents and warrants that he is an officer of the organization for which he has executed this contract and that he has full and complete authority to enter into this contract on behalf of his firm. The undersigned signatory for the OWNER hereby represents and warrants that he/she has full and complete authority to enter into this contract on behalf of this organization. PHASE 1 DESIGN SERVICES — "WAL-MART STREETS" AND CONDEMNATION R -O -W PARCEL SURVEYS 1. The Amendment No. 3 Phase I Basic Design Services are outlined in detail in Exhibit A-1, Worksheet A3 -1B, according to the tasking and man-hours indicated therein. Following is a summary of the major categories for the Phase 1 Basic Design Services to be performed: a. Municipal Paving and Drainage Construction Documents Avenue T, full width curb -to -curb, from tie-in at Marsha Sharp Freeway at south end of radius to south end of radius at intersection with 7th Street; 7th Street, full width curb -to -curb, from intersection with Avenue T to east end of radius of intersection with Avenue R; Avenue R, full width curb -to -curb, from tie-in at Marsha Sharp Freeway at south end of radius to south end of radius at intersection with 7th Street; Storm sewer inlets and piping from intersection of Avenue T and (th Street south to 7th Street and east to tie-in with existing storm sewer west of intersection with Avenue R; R -O -W parcels, both sides of GGB from Avenue Q to Avenue S; Coordination with utilities companies. b. Amenities Construction Documents Parkway amenities for the "Wal-Mart project" are being provided via separate design and construction contracts. The design deliverables will include one design package of plans, specifications, and estimates each for the Documents specified in Items I.A.I.a. above. 3. Each design package deliverable will consist of one set of reproducible mylar original plans, one hard -copy set of the noted specification sections, a bid form, and a final opinion of probable cost. 4. HRA will provide one hard -copy and one electronic copy of all pertinent design data including plans, specifications, opinion of probable cost, and supporting data, computer models, and other calculations and information utilized in the development of the design package. B. PHASE 2 DESIGN SERVICES — "RESIDENTIAL STREETS" The Amendment No. 3 Phase 2 Basic Design Services are outlined in detail in Exhibit A-1, Worksheet A3 -2B, according to the tasking and man-hours indicated therein. Following is a summary of the major categories for the Phase 2 Basic Design Services to be performed: a. Municipal Paving and Drainage Design and Construction Documents 7th Street, full width curb -to -curb, from Avenue V to Avenue U; 0 Street, full width curb -to -curb, from Avenue V to west end of radius of intersection with Avenue R; 10t4 Street, full width curb -to -curb, from Avenue V to west of Avenue S; Avenue U, full width curb -to -curb, from the north end of radius at the intersection with 7`h Street to the north end of radius at the intersection with Main Street; Avenue T, full width curb -to -curb, from 9th Street to 10th Street; Relocate storm sewer inlets and extend piping from intersection of Avenue R and 9th Street west to approximately the Avenue S intersection, if required for drainage; also, relocate inlets and extend piping from intersection of Avenue S and 10th Street west to clear the future roundabout at that intersection. Coordination with utilities companies. b. The design deliverables will include one design package of plans, specifications, and estimates each for the Documents specified in Items I.B. La. and I.B. Lb. above. The packages will be bid separately. HRA will provide one hard -copy and one electronic copy of all pertinent design data including plans, specifications, opinion of probable cost, and supporting data, computer models, and other calculations and information utilized in the development of the design package. C. SUPPLEMENTAL ,SERVICES 1. HRA will provide all surveying services as outlined in Exhibit A-1, Worksheet A3 -S, for the purposes of establishing the necessary control and acquiring the necessary field data for the performance of the Amendment Basic Design Services. These services include the R -O -W parcel surveys necessary for GGB condemnation proceedings at the direction of the City of Lubbock. 2. HRA will provide one hard -copy of all survey notes and records, and one electronic copy of all survey data so formatted. Amendment No. 3 to Contract for Engineering Services for Design and Bid: Glenna Goodacre Boulevard Project Page 6 ATTACHMENT B to AMENDMENT No. 3 to AGREEMENT FOR ENGINEERING SERVICES BASIS for PAYMENT OWNER: City of Lubbock, Texas PROJECT: Amendment No. 3 to Agreement for Engineering Services for Design and Bid: Glenna Goodacre Boulevard Project in Overton Park, Lubbock For Services rendered under this Contract, OWNER agrees to pay HRA as follows: A. GENERAL 1. HRA will be paid according to the personnel classifications and hourly rate schedules shown in Table C, based on actual services performed on the project by classification and hours. Services performed by the subcontractor will be billed at cost. Reimbursable expenses will be paid at cost plus 15% for both HRA and the subcontractor. 2. Monthly payments will be made to HRA based on the uncontested amount of each monthly statement prepared and submitted by HRA. Each monthly statement will be itemized to show the amount of work actually performed by each personnel classification and with associated reimbursable expenses for both HRA and the subcontractor. Statements will be submitted in a format acceptable to OWNER. 3. Anticipated delivery date of the project Amendment Phase 1 design deliverables is on or about November 18, 2005. Anticipated delivery date of deliverables for the roadway portions of 10'h Street from Avenue V to Avenue U is on or about November 18, 2005. Anticipated delivery date of the remainder of the project Amendment Phase 2 roadway design deliverables is on or about January 30, 2006. Delivery of the amenities portions of the design proiect will lag deliveries of the roadway portions and will be bid separately from the roadway portions. The anticipated delivery dates are based on having an executed contract Amendment and N.T.P. no later than November 11 2005. Should the N.T.P. on the Project not be received by the anticipated date, OWNER agrees that it will be necessary to reconsider the anticipated delivery date and, if necessary, to modify same by amendment to this contract if so agreed upon by both the OWNER and HRA..
